Abelson <a href=\"https:\/\/www2.mdd.uscourts.gov\/Opinions\/Opinions\/2025-08-01_Kalshiex_Deny_Mot_for_PI_(25-cv-1283).pdf\" target=\"_blank\" rel=\"noopener\">denied<\/a> Kalshi\u2019s position, in what is a significant defeat for their aims to offer prediction markets nationwide under federal jurisdiction and oversight.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Kalshi is a CFTC-regulated platform that offers event or outcome-based \u2018contracts\u2019, typically on sports and political outcomes. The company had argued that the Commodity Exchange Act (CEA) pre-empts state gambling laws, granting exclusive regulatory authority to the CFTC.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Conversely, Maryland, like several other states, issued a cease-and-desist order, claiming Kalshi\u2019s sports event contracts constitute illegal gambling under state law.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Judge Abelson has now ruled in their favor.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Specifically, he outlined that the financial exchange and prediction market (<a href=\"https:\/\/readwrite.com\/kalshi-xai-announce-partnership\/\">which recently secured a partnership with xAI<\/a>) had not demonstrated its prospects for success in proving Congress intended the CEA to take precedence over state gambling laws, especially for sports-related markets.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Abelson stressed the importance of upholding the states\u2019 authority on gambling, as ceding in Kalshi\u2019s favor against Maryland would have wide-ranging consequences for state-level regulations across the entire United States, including federal arrangements such as the Wire Act and the Indian Gaming Regulatory Act.\u00a0<\/span><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Federal judges in different states have now issued conflicting rulings on whether states can use sports betting laws to regulate Kalshi and its sports-based event contracts, or whether states are preempted.
