First it will eliminate the draft, allowing newcomers to the league to pick which team they sign for. Second, it will lift any limits on the earnings potential of individual players.\u00a0<\/p>\n<p>The NWSL decided to do so after a bout of self-reflection, according to its commissioner <a href=\"https:\/\/fortune.com\/2023\/05\/05\/nwsl-commissioner-jessica-berman-is-encouraging-the-league-to-be-long-term-greedy\/\" target=\"_self\" aria-label=\"Go to https:\/\/fortune.com\/2023\/05\/05\/nwsl-commissioner-jessica-berman-is-encouraging-the-league-to-be-long-term-greedy\/\" class=\"sc-93594058-0 hoNHBb\" rel=\"noopener\">Jessica Berman<\/a>.\u00a0<\/p>\n<p>Berman said since being <a href=\"https:\/\/www.cbsnews.com\/news\/jessica-berman-national-womens-soccer-league-commissioner\/\" target=\"_blank\" aria-label=\"Go to https:\/\/www.cbsnews.com\/news\/jessica-berman-national-womens-soccer-league-commissioner\/\" rel=\"noopener\" class=\"sc-93594058-0 hoNHBb\">appointed<\/a> commissioner in March 2022 she had numerous conversations with the board about whether the NWSL should emulate American sports leagues like the NBA, NFL, and NHL, or soccer leagues from other countries. \u201cThere\u2019s friction that exists between those two worlds,\u201d Berman told <em>Fortune<\/em>. \u201cThe sport of soccer is a global game, we operate our business in the US.\u201d<\/p>\n<p>Ultimately the NWSL decided to split the difference, ditching the draft altogether but keeping American-style salary caps albeit with a twist. Under the new agreement, teams will have a fixed salary cap, however, they can spend it with far fewer restrictions than other American sports. Namely, teams will be able to pay a star player however much they would like, provided they remain under the salary cap. Players also can\u2019t be traded without their consent, as is currently the standard in other major sports leagues.<\/p>\n<p>\u201cThere\u2019s immense power in players having autonomy and control over their careers,\u201d said NWSL Players\u2019 Association executive director Meghann Burke in an interview Wednesday night.<\/p>\n<p>Under the new agreement the salary cap for NWSL teams rose to $3.3 million, up from $2.75 million under the previous deal signed in 2022. The minimum salary increased from $35,000 to $48,500, a 38.5% increase. By the end of the deal in 2030 the salary cap is projected to increase to $5.1 million and the minimum salary to $82,500.\u00a0<\/p>\n<p>These new changes were an effort to adapt the league to the global realities of soccer, the world\u2019s most popular sport, according to Berman. \u201cSoccer is one of the few sports where there is truly a global labor market for talent,\u201d she said.\u00a0<\/p>\n<p>In virtually all U.S. sports, both men\u2019s and women\u2019s, the draft is considered a rite of passage that marks the moment an amateur player turns pro. But in the rest of the world it\u2019s often seen as an American peculiarity, one that often prevents a player from choosing where they will ply their trade.\u00a0<\/p>\n<p>\u201cWe\u2019ve accepted this paradigm of sports that I don\u2019t think a lot of American sports fans really understand, until they think about it, that that\u2019s not the way the rest of the world does it,\u201d said Burke, who was a professional player before getting her J.D. in labor law from Northeastern University School of Law.\u00a0<\/p>\n<p>Over the past two years the NWSL has been at the center of an investment bonanza in <a href=\"https:\/\/www.nbcnews.com\/news\/us-news\/womens-sports-rake-1-billion-first-time-2024-300-2021-rcna127622\" target=\"_blank\" aria-label=\"Go to https:\/\/www.nbcnews.com\/news\/us-news\/womens-sports-rake-1-billion-first-time-2024-300-2021-rcna127622\" rel=\"noopener\" class=\"sc-93594058-0 hoNHBb\">women\u2019s sports<\/a>. Earlier this year the league added <a href=\"https:\/\/frontofficesports.com\/nwsl-expansion-and-viewership-surge-driving-a-record-season\/#:~:text=This%20year%2C%20the%20NWSL%20expanded,for%20around%2020%2C000%20fans%20each.\" target=\"_blank\" aria-label=\"Go to https:\/\/frontofficesports.com\/nwsl-expansion-and-viewership-surge-driving-a-record-season\/#:~:text=This%20year%2C%20the%20NWSL%20expanded,for%20around%2020%2C000%20fans%20each.\" rel=\"noopener\" class=\"sc-93594058-0 hoNHBb\">two new teams<\/a> and attracted a slew of high-profile investors. <a href=\"https:\/\/fortune.com\/company\/disney\/\" target=\"_blank\" aria-label=\"Go to https:\/\/fortune.com\/company\/disney\/\" class=\"sc-93594058-0 hoNHBb\" rel=\"noopener\">Disney<\/a> CEO Bob Iger <a href=\"https:\/\/www.latimes.com\/entertainment-arts\/business\/story\/2024-07-17\/willow-bay-bob-iger-buy-controlling-stake-angel-city-football-club\" target=\"_blank\" aria-label=\"Go to https:\/\/www.latimes.com\/entertainment-arts\/business\/story\/2024-07-17\/willow-bay-bob-iger-buy-controlling-stake-angel-city-football-club\" rel=\"noopener\" class=\"sc-93594058-0 hoNHBb\">bought a majority stake<\/a> in the Los Angeles-based <a href=\"https:\/\/fortune.com\/2023\/07\/26\/womens-world-cup-angel-city-fc-founder-kara-nortman\/\" target=\"_self\" aria-label=\"Go to https:\/\/fortune.com\/2023\/07\/26\/womens-world-cup-angel-city-fc-founder-kara-nortman\/\" class=\"sc-93594058-0 hoNHBb\" rel=\"noopener\">Angel City FC<\/a>. The league has also managed to draw institutional investors. In April 2023, the private equity firm Sixth Street Partners, <a href=\"https:\/\/fortune.com\/2024\/04\/02\/sixth-street-goldman-sachs-alan-waxman-chavez-tpg-wall-street-ipos-private-equity\/?utm_source=search&amp;utm_medium=suggested_search&amp;utm_campaign=search_link_clicks\" target=\"_self\" aria-label=\"Go to https:\/\/fortune.com\/2024\/04\/02\/sixth-street-goldman-sachs-alan-waxman-chavez-tpg-wall-street-ipos-private-equity\/?utm_source=search&amp;utm_medium=suggested_search&amp;utm_campaign=search_link_clicks\" class=\"sc-93594058-0 hoNHBb\" rel=\"noopener\">known<\/a> for its major sports investments, <a href=\"https:\/\/justwomenssports.com\/reads\/nwsl-san-francisco-bay-area-expansion-valuation-record\/\" target=\"_blank\" aria-label=\"Go to https:\/\/justwomenssports.com\/reads\/nwsl-san-francisco-bay-area-expansion-valuation-record\/\" rel=\"noopener\" class=\"sc-93594058-0 hoNHBb\">bought<\/a> the NWSL\u2019s San Francisco team <a href=\"https:\/\/fortune.com\/2024\/04\/04\/sixth-street-goldman-sachs-tao-bay-fc-sports-deals-soccer-wall-street-private-equity\/\" target=\"_self\" aria-label=\"Go to https:\/\/fortune.com\/2024\/04\/04\/sixth-street-goldman-sachs-tao-bay-fc-sports-deals-soccer-wall-street-private-equity\/\" class=\"sc-93594058-0 hoNHBb\" rel=\"noopener\">Bay FC<\/a>.\u00a0\u00a0\u00a0\u00a0<\/p>\n<p>But as the NWSL\u2019s fortune\u2019s grew, so did those of other women\u2019s leagues. Like in the U.S., women\u2019s soccer in Europe has undergone a <a href=\"https:\/\/www.nytimes.com\/athletic\/5586630\/2024\/06\/25\/wsl-deloitte-financial-report\/\" target=\"_blank\" aria-label=\"Go to https:\/\/www.nytimes.com\/athletic\/5586630\/2024\/06\/25\/wsl-deloitte-financial-report\/\" rel=\"noopener\" class=\"sc-93594058-0 hoNHBb\">financial boom<\/a> in recent years. In England (which is also home to the most <a href=\"https:\/\/www.wsj.com\/sports\/soccer\/premier-league-manchester-city-case-1ea9a10f\" target=\"_blank\" aria-label=\"Go to https:\/\/www.wsj.com\/sports\/soccer\/premier-league-manchester-city-case-1ea9a10f\" rel=\"noopener\" class=\"sc-93594058-0 hoNHBb\">lucrative<\/a> men\u2019s league) revenue for the Women\u2019s Super League was <a href=\"https:\/\/www.bbc.com\/sport\/football\/articles\/c6ppelxvzkdo#:~:text=The%20aggregate%20revenue%20of%20Women's,%C2%A368m%20in%202024%2D25.\" target=\"_blank\" aria-label=\"Go to https:\/\/www.bbc.com\/sport\/football\/articles\/c6ppelxvzkdo#:~:text=The%20aggregate%20revenue%20of%20Women's,%C2%A368m%20in%202024%2D25.\" rel=\"noopener\" class=\"sc-93594058-0 hoNHBb\">up 50%<\/a> in the 2023-2024 season. A March 2022 in the Women\u2019s Champions League, the continent\u2019s premier competition, between Spanish giants Real Madrid and Barcelona set an <a href=\"https:\/\/www.espn.com\/soccer\/story\/_\/id\/37626889\/barcelona-real-madrid-womens-champions-league-clash-breaks-attendance-world-record#\" target=\"_blank\" aria-label=\"Go to https:\/\/www.espn.com\/soccer\/story\/_\/id\/37626889\/barcelona-real-madrid-womens-champions-league-clash-breaks-attendance-world-record#\" rel=\"noopener\" class=\"sc-93594058-0 hoNHBb\">attendance record<\/a> with over 93,000 fans.\u00a0<\/p>\n<p>The need to act became even more apparent after the <a href=\"https:\/\/fortune.com\/2023\/07\/20\/womens-world-cup-fifa-gender-gap-equal-pay-gianni-infantino\/\" target=\"_self\" aria-label=\"Go to https:\/\/fortune.com\/2023\/07\/20\/womens-world-cup-fifa-gender-gap-equal-pay-gianni-infantino\/\" class=\"sc-93594058-0 hoNHBb\" rel=\"noopener\">2023 Women\u2019s World Cup<\/a> in which the U.S. was <a href=\"https:\/\/fortune.com\/2023\/08\/08\/us-womens-soccer-uswnt-world-cup-3-3-million-record-payout\/\" target=\"_self\" aria-label=\"Go to https:\/\/fortune.com\/2023\/08\/08\/us-womens-soccer-uswnt-world-cup-3-3-million-record-payout\/\" class=\"sc-93594058-0 hoNHBb\" rel=\"noopener\">eliminated<\/a> in the first knockout round, Burke said. She said she realized it was \u201cundeniably true\u201d that \u201cthe world is passing us by.\u201d<\/p>\n<p>After that disappointment the U.S. and the NWSL realized they had to adapt in order to regain their perch atop the soccer world. \u201cWe compete for the world\u2019s best talent in the global market, and so it really didn\u2019t make any sense to play by one set of rules, while all our competitors in England and Spain and France and Germany and Mexico play by different federal rules, especially when those rules give them the advantage,\u201d Burke said.<\/p>\n<p>In addition to the draft, standing in the way of recruiting that global talent was a practice known as service years, which dictated how long a player had to have been in the league before they were eligible for free agency. The rule made it harder for players to move between teams when their contracts expired. Typically, the most sought-after players are eager to enter free agency because it opens up a bidding war for their services among teams that want to sign them. Over the last year, free agency has been a contentious topic between the NWSL and the players\u2019 union, ending up in an <a href=\"https:\/\/www.nytimes.com\/athletic\/4778670\/2023\/08\/15\/nwsl-arbitration-free-agency\/#\" target=\"_blank\" aria-label=\"Go to https:\/\/www.nytimes.com\/athletic\/4778670\/2023\/08\/15\/nwsl-arbitration-free-agency\/#\" rel=\"noopener\" class=\"sc-93594058-0 hoNHBb\">arbitration dispute<\/a> on <a href=\"https:\/\/www.nytimes.com\/athletic\/3539143\/2022\/08\/25\/nwsl-free-agency-dispute\/\" target=\"_blank\" aria-label=\"Go to https:\/\/www.nytimes.com\/athletic\/3539143\/2022\/08\/25\/nwsl-free-agency-dispute\/\" rel=\"noopener\" class=\"sc-93594058-0 hoNHBb\">more than one<\/a> occasion.\u00a0<\/p>\n<p>The new CBA allows all NWSL players to enter free agency whenever their current contract expires without needing to accumulate service years. The contract does still keep the salary cap in place, long used as a way to encourage parity among teams in American sports, which Berman cited. However, teams can allocate that among individual players however they see fit.\u00a0<\/p>\n<p>Berman said she hoped the new policy would give team\u2019s more flexibility in how they built their rosters. \u201cIt\u2019ll be up to the team if they want to fill their roster with 21 times the minimum and sign one big-time player or smooth it out so that they\u2019re being more prescriptive about different positions,\u201d she said.\u00a0<\/p>\n<p>The timing of the deal was also notable for a collective bargaining agreement. It came roughly two and a half years before the expiration of the current deal at the end of the 2026 season.
