The suit calls out the \u201cdeceptive practice of charging hidden junk fees\u201d and refers to it as a \u201cclassic bait-and-switch scheme.\u201d<\/p>\n<p>Anyone who has purchased a ticket via StubHub, or many of its rivals, are probably intimately familiar with the sticker shock that arrives at check out. The added fees can boost the total cost of a ticket by up to 40 percent, the lawsuit alleges. Attorney General Brian L. Schwalb says this is due to \u201ca series of deceptive, manipulative, and unfair practices.\u201d<\/p>\n<div class=\"twitter-tweet-wrapper\" data-embed-anchor=\"72926408-d6bb-575f-809e-d0efd68b6edb\">\n<blockquote placeholder=\"\" data-theme=\"light\" class=\"twitter-tweet\">\n<p>Here is how StubHub&#8217;s drip pricing scheme works:<\/p>\n<p>1\ufe0f\u20e3 First, StubHub baits customers to shop for tickets by displaying deceptively low prices that do not include mandatory fees.<\/p>\n<p>The true, significantly higher price with junk fees is not revealed until the very end of the process. <a href=\"https:\/\/t.co\/EsRj0uy3e2\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:pic.twitter.com\/EsRj0uy3e2;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">pic.twitter.com\/EsRj0uy3e2<\/a><\/p>\n<p>\u2014 AG Brian Schwalb (@DCAttorneyGen) <a href=\"https:\/\/twitter.com\/DCAttorneyGen\/status\/1818606444750537131?ref_src=twsrc%5Etfw\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:July 31, 2024;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">July 31, 2024<\/a><\/p>\n<\/blockquote>\n<\/div>\n<p>These practices include the aforementioned bait-and-switch. The company allegedly advertises \u201cdeceptively low\u201d ticket prices, adding extra charges after the consumer has clicked on multiple pages. Throughout this whole process, StubHub displays a countdown timer, urging users to act swiftly and, thereby, accept those added fees without really thinking about it. Schwalb calls this a \u201cdark pattern\u201d that creates a \u201cfalse sense of urgency.\u201d This is otherwise <a data-i13n=\"cpos:2;pos:1\" href=\"https:\/\/twitter.com\/DCAttorneyGen\/status\/1818606444750537131\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:known as drip pricing;cpos:2;pos:1;elm:context_link;itc:0;sec:content-canvas\" class=\"link \"><\/a>.<\/p>\n<p>The fees themselves are also said to be attributed to vague and cryptic policies, like \u201cfulfillment and service.\u201d These policies lack adequate explanation and the associated fees vary wildly, according to the suit. The lawsuit points out that StubHub doesn\u2019t disclose how these fees are calculated or what they\u2019re even for.<\/p>\n<p>The complaint goes on to allege that StubHub has sold 4.9 million tickets and accrued over $118 million in hidden fees just in Washington DC by relying on the above methods. This lawsuit doesn\u2019t crunch the numbers for other cities, like New York City, Los Angeles and Chicago, though I have a hunch that those residents also attend ticketed events in large numbers.<\/p>\n<p>\u201cWe are disappointed that the DC Attorney General is targeting StubHub when our user experience is consistent with the law, our competitors\u2019 practices, and the broader e-commerce sector,\u201d John Lawrence, StubHub\u2019s deputy general counsel, <a data-i13n=\"cpos:3;pos:1\" href=\"https:\/\/www.theverge.com\/2024\/7\/31\/24209853\/stubhub-hidden-junk-fees\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:wrote in a statement to The Verge;cpos:3;pos:1;elm:context_link;itc:0;sec:content-canvas\" class=\"link \"><em><\/em><\/a>.<\/p>\n<p>To the point of being \u201cconsistent with the law,\u201d Schwalb claims that StubHub has violated the District of Columbia\u2019s Consumer Protection Procedures Act (CPPA). The aforementioned drip pricing strategy isn\u2019t allowed, as the law requires merchants to provide factual information regarding consumer goods sold in the city. The AG has asked the court to financially penalize StubHub and for an injunction to stop the allegedly deceptive practices.<\/p>\n<p>\u201cHidden fees in the ticketing industry have truly gotten out of control. The price that is advertised is the price that we should pay\u2014full stop,\u201d wrote National Consumers League CEO Sally Greenberg <a data-i13n=\"cpos:4;pos:1\" href=\"https:\/\/oag.dc.gov\/release\/attorney-general-schwalb-sues-stubhub-deceptive\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:in a press release;cpos:4;pos:1;elm:context_link;itc:0;sec:content-canvas\" class=\"link \"><\/a> that accompanied the lawsuit.<\/p>\n<p>This is just the latest attempt to dissuade ticket sellers from using junk fees to line their coffers. The federal government, under President Biden, has been <a data-i13n=\"cpos:5;pos:1\" href=\"https:\/\/www.klobuchar.senate.gov\/public\/index.cfm\/news-releases?ID=761FFC1F-E897-41E0-88AE-D6431E619751\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:trying to tamp down these practices;cpos:5;pos:1;elm:context_link;itc:0;sec:content-canvas\" class=\"link \"><\/a> since 2022, when Ticketmaster caused a straight-up fiasco by <a data-i13n=\"cpos:6;pos:1\" href=\"https:\/\/www.engadget.com\/senate-antitrust-hearing-ticketmaster-taylor-swift-live-nation-175441631.html\" data-ylk=\"slk:promising more Taylor Swift tickets;cpos:6;pos:1;elm:context_link;itc:0;sec:content-canvas\" class=\"link \"><\/a> than were actually available and adding plenty of junk fees. In 2023, the FTC proposed a rule to ban junk fees. There will be a decision issued on this by the end of the year.<\/p>\n<p>The House also passed a bill back in May to force ticket sellers to display the actual prices at the start of the purchasing process and not at the very end.
