The decision applies to both US citizens and international visitors entering the region, which includes New York City, the <a data-i13n=\"cpos:2;pos:1\" href=\"https:\/\/www.cntraveler.com\/story\/most-visited-american-cities\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:most-visited;cpos:2;pos:1;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">most-visited<\/a> site by overseas travelers.<\/p>\n<p>The case stems from a 2022 incident in which border agents manually searched the phone of a man named Kurbonali Sultanov at <a data-i13n=\"cpos:3;pos:1\" href=\"https:\/\/www.engadget.com\/2018-07-23-new-york-jfk-airport-screen-luggage-ct-scanner.html\" data-ylk=\"slk:JFK Airport;cpos:3;pos:1;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">JFK Airport<\/a> in New York. He initially refused and then handed over the device once agents said he had no choice. The phone was later searched more thoroughly with a warrant, but Sultanov moved to suppress evidence obtained during the initial search, claiming it violated his rights.<\/p>\n<p>Civil liberties groups backed the motion. &#8220;As the court recognizes, warrantless searches of electronic devices at the border are an unjustified intrusion into travelers&#8217; private expressions, personal associations, and journalistic endeavors \u2014 activities the First and Fourth Amendments were designed to protect,&#8221; said Scott Wilkens, <a data-i13n=\"cpos:4;pos:1\" href=\"https:\/\/knightcolumbia.org\/content\/federal-court-says-warrant-required-for-device-searches-at-the-border\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:senior counsel at the Knight First Amendment Institute;cpos:4;pos:1;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">senior counsel at the Knight First Amendment Institute<\/a>. The court didn&#8217;t dismiss the evidence, however, claiming the border agents acted in good faith.<\/p>\n<p>The debate over whether border control agents can search electronic devices has raged for years.
