After facing an existential lawsuit from the Securities and Exchange Commission late last year, Wyoming-based crypto company Debt Box revealed prosecutors had misled a federal judge. In response, the judge imposed unprecedented <a href=\"https:\/\/fortune.com\/crypto\/2024\/03\/18\/gary-gensler-sec-debt-box-crypto-sanctions-utah\/\" target=\"_self\" aria-label=\"Go to https:\/\/fortune.com\/crypto\/2024\/03\/18\/gary-gensler-sec-debt-box-crypto-sanctions-utah\/\" class=\"sc-82aca549-0 klXAci\" rel=\"noopener\">sanctions<\/a> on the Gary Gensler-led agency, producing an uproar across the crypto industry, and <a href=\"https:\/\/fortune.com\/crypto\/2024\/02\/08\/vance-lummis-debt-box-sec-gary-gensler-lawsuit-crypto\/\" target=\"_self\" aria-label=\"Go to https:\/\/fortune.com\/crypto\/2024\/02\/08\/vance-lummis-debt-box-sec-gary-gensler-lawsuit-crypto\/\" class=\"sc-82aca549-0 klXAci\" rel=\"noopener\">rebukes<\/a> of the SEC from politicians including J.D. Vance (R-Ohio).<\/p>\n<div>\n<p>During this time, however, one of the main defendants\u2014Jason Anderson, the co-founder and co-owner of the company\u2014traveled to Dubai for a business meeting, according to a police report later filed in Utah by his brother and obtained by <em>Fortune<\/em>. When Anderson tried to leave the country, two of his business partners allegedly kidnapped him and forced him to turn over $400 million, along with control of Debt Box itself, under mental \u201ctorture,\u201d according to the brother\u2019s testimony in the report. <\/p>\n<p>The Anderson brothers did not respond to multiple requests for comment.  <\/p>\n<p>The case is currently in limbo, as the SEC decides whether it will refile the charges. But new details from the police report, interviews with key stakeholders, and other documents viewed by <em>Fortune<\/em> reveal that the story of Debt Box is still unfolding, as hundreds of millions of dollars remain in limbo and business partners feud over the future of the project. It\u2019s a story that could only happen in the topsy-turvy world of crypto\u2014and one that reflects the perils of the SEC\u2019s scorched earth campaign against the volatile sector.<\/p>\n<h2 class=\"wp-block-heading\">The lawsuit<\/h2>\n<p>Debt Box launched in 2021, offering crypto users a way to invest in \u201cnode software licenses\u201d that would allow them to \u201cmine\u201d  different crypto assets tied to real assets such as gold and oil. The SEC <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.utd.141167\/gov.uscourts.utd.141167.1.0.pdf\" target=\"_blank\" aria-label=\"Go to https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.utd.141167\/gov.uscourts.utd.141167.1.0.pdf\" rel=\"noopener\" class=\"sc-82aca549-0 klXAci\">sued<\/a> the company in federal court last July, however, arguing in a sealed complaint that Debt Box had offered unregistered digital assets that were a \u201csham.\u201d Still, the project proved lucrative, netting the company nearly $50 million from investors.<\/p>\n<p>As part of the charges, the SEC argued the defendants\u2014who included the two Anderson brothers, 11 other business partners, and a handful of related firms\u2014were taking steps to evade law enforcement, including moving operations to the United Arab Emirates. The SEC secured a temporary restraining order and asset freeze from the judge, using an extraordinary process in which defendants are not even notified of the case against them.<\/p>\n<p>The agency\u2019s case began to unravel in December. Upon learning of the seizures, which included closing Debt Box bank accounts, the company\u2019s attorneys argued that the SEC had obtained the secret restraining order without justification. The judge <a href=\"https:\/\/fortune.com\/crypto\/2023\/12\/01\/federal-judge-sec-crypto-debt-box-rebuke-restraining-order-gensler\/\" target=\"_self\" aria-label=\"Go to https:\/\/fortune.com\/crypto\/2023\/12\/01\/federal-judge-sec-crypto-debt-box-rebuke-restraining-order-gensler\/\" class=\"sc-82aca549-0 klXAci\" rel=\"noopener\">responded<\/a> by ordering prosecutors to share more evidence.<\/p>\n<p>After SEC enforcement chief Gurbir Grewal <a href=\"https:\/\/fortune.com\/crypto\/2023\/12\/22\/sec-error-debt-box-utah-gary-gensler-crypto\/\" target=\"_self\" aria-label=\"Go to https:\/\/fortune.com\/crypto\/2023\/12\/22\/sec-error-debt-box-utah-gary-gensler-crypto\/\" class=\"sc-82aca549-0 klXAci\" rel=\"noopener\">admitted<\/a> the agency had fallen \u201cshort,\u201d the judge <a href=\"https:\/\/fortune.com\/crypto\/2024\/03\/18\/gary-gensler-sec-debt-box-crypto-sanctions-utah\/\" target=\"_self\" aria-label=\"Go to https:\/\/fortune.com\/crypto\/2024\/03\/18\/gary-gensler-sec-debt-box-crypto-sanctions-utah\/\" class=\"sc-82aca549-0 klXAci\" rel=\"noopener\">slapped<\/a> the agency with financial penalties for its \u201cbad faith\u201d conduct in mid-March\u2014an unprecedented action against a federal agency\u2014and dismissed the case, though in a way that gave the SEC the option to refile the charges at a later date. The disastrous lawsuit soon became a rallying cry for Gensler\u2019s <a href=\"https:\/\/fortune.com\/crypto\/2024\/02\/08\/vance-lummis-debt-box-sec-gary-gensler-lawsuit-crypto\/\" target=\"_self\" aria-label=\"Go to https:\/\/fortune.com\/crypto\/2024\/02\/08\/vance-lummis-debt-box-sec-gary-gensler-lawsuit-crypto\/\" class=\"sc-82aca549-0 klXAci\" rel=\"noopener\">outspoken critics<\/a> in the crypto industry and across Congress, with the two lawyers leading the case later <a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2024-04-22\/sec-lawyers-resign-after-judge-blasts-agency-for-abuse-of-power-in-crypto-case?sref=2jPYL79S\" target=\"_blank\" aria-label=\"Go to https:\/\/www.bloomberg.com\/news\/articles\/2024-04-22\/sec-lawyers-resign-after-judge-blasts-agency-for-abuse-of-power-in-crypto-case?sref=2jPYL79S\" rel=\"noopener\" class=\"sc-82aca549-0 klXAci\">stepping down<\/a> after being told they would be terminated, according to Bloomberg.<\/p>\n<p>It turns out, however, that the SEC\u2019s fears the Debt Box executives were poised to flee the country with investors\u2019 assets may have been warranted.<\/p>\n<h2 class=\"wp-block-heading\">The alleged kidnapping <\/h2>\n<p>In early June, according to the police report obtained by <em>Fortune<\/em>, an officer in Draper, Utah was dispatched to investigate the reported abduction of Jason Anderson. He interviewed the victim\u2019s brother, Jacob, who said that Jason had gone to Dubai for a business meeting on March 1. When he tried to leave the country, his passport was flagged and he was taken to a back room by airport staff.<\/p>\n<p>Then, according to the brother, he was driven four hours away and placed in a hotel room that was locked from the outside. Two of Anderson\u2019s business partners, Schad Brannon and Roydon Nelson, then allegedly spent two weeks \u201cmentally torturing\u201d him (the report offers no further details) until he agreed to sign away Debt Box and nearly $400 million, and attest that he owed \u201cpeople\u201d in Dubai another $90 million. Anderson only managed to get a message to his brother through an internet-enabled T.V. remote and, without a passport, was unable to leave the country.<\/p>\n<p>Anderson\u2019s extraordinary story, as detailed in the report, contains some notable holes. For one, the police officer states that the FBI field office in Salt Lake City advised him that agents in Dubai were already aware of the situation. According to the FBI, Dubai police had already visited Jason Anderson at the hotel, where there was no indication of kidnapping. The U.S. embassy in Dubai was also aware of the situation and had advised Anderson on how to procure a new passport\u2014though the FBI also confirmed there was an active criminal case in Dubai against Anderson preventing him from leaving the country.<\/p>\n<p>Jason Anderson has also continued to appear in <a href=\"https:\/\/www.youtube.com\/live\/84ZkAClCOjk?si=hKgxmeONgBRUaHBa\" target=\"_blank\" aria-label=\"Go to https:\/\/www.youtube.com\/live\/84ZkAClCOjk?si=hKgxmeONgBRUaHBa\" rel=\"noopener\" class=\"sc-82aca549-0 klXAci\">YouTube interviews<\/a> dated in late June\u2014three months after the alleged kidnapping\u2014where he lays out his plans to relaunch Debt Box, which lays further doubts that he is being held against his will in Dubai.<\/p>\n<p>The U.S. Attorney\u2019s office in Utah and the U.S. embassy in Dubai did not respond to a request for comment from <em>Fortune<\/em>. An attorney representing Brannon and Nelson told <em>Fortune<\/em> that his clients were not aware of a police report made by Jacob Anderson and denied any allegations of kidnapping. Brannon and Nelson both hold high-ranking positions at Debt Box, with Brannon serving as president and Nelson holding several titles, including director, reflecting an ongoing business dispute between the firm\u2019s top brass. <\/p>\n<p>According to another business partner, who spoke with <em>Fortune<\/em> on the condition of anonymity to discuss an ongoing legal situation, Jacob Anderson continues to insist that his brother is kidnapped and money is frozen\u2014a continued point of contention among the web of defendants. Jacob Anderson also contacted the U.S. embassy in Abu Dhabi with similar details, including that his brother was set to meet members of the \u201cRoyal Family,\u201d according to an email viewed by <em>Fortune<\/em>.<\/p>\n<p>With the SEC off the Debt Box case following the judge\u2019s rebuke, at least for now, the saga appears to reinforce the worst fears endemic to the Wild West sector\u2014and this time with no sheriff.
