In the midst of campus protests, schools like Harvard, Columbia, and NYU have tried\u2014and often failed\u2014to uphold longstanding free speech traditions on one hand, while condemning antisemitism on the other.\u00a0<\/p>\n<div>\n<p>Now, one of the country\u2019s preeminent corporate law firms is stepping into the fray, declaring that colleges have failed to protect Jewish students from hateful and antisemitic rhetoric.\u00a0<\/p>\n<p>Sullivan &amp; Cromwell, whose recent clients include <a href=\"https:\/\/fortune.com\/company\/amazon-com\/\" target=\"_blank\" aria-label=\"Go to https:\/\/fortune.com\/company\/amazon-com\/\" class=\"sc-80b85506-0 pUpMT\" rel=\"noopener\">Amazon<\/a>, <a href=\"https:\/\/fortune.com\/company\/bp\/\" target=\"_blank\" aria-label=\"Go to https:\/\/fortune.com\/company\/bp\/\" class=\"sc-80b85506-0 pUpMT\" rel=\"noopener\">BP<\/a>, and <a href=\"https:\/\/fortune.com\/company\/goldman-sachs-group\/\" target=\"_blank\" aria-label=\"Go to https:\/\/fortune.com\/company\/goldman-sachs-group\/\" class=\"sc-80b85506-0 pUpMT\" rel=\"noopener\">Goldman Sachs<\/a>, has employed background check company HireRight to root out job applicants who have participated in recent anti-Israel demonstrations on campuses, <a href=\"https:\/\/www.nytimes.com\/2024\/07\/08\/business\/sullivan-cromwell-israel-protests.html\" target=\"_blank\" aria-label=\"Go to https:\/\/www.nytimes.com\/2024\/07\/08\/business\/sullivan-cromwell-israel-protests.html\" rel=\"noopener\" class=\"sc-80b85506-0 pUpMT\">according to a recent report from <em>the New York Times<\/em><\/a>.\u00a0<\/p>\n<p>Under the new policy, applicants who have taken part in antisemitic protests, or in demonstrations in which phrases that might be \u201ctriggering\u201d to Jews have been uttered, could potentially be disqualified, according to Joseph Shenker, a senior chair at the firm.\u00a0<\/p>\n<p>\u201cPeople are taking their outrage about what\u2019s going on in Gaza and turning it into racist antisemitism,\u201d Shenker told <em>the<\/em> <em>Times<\/em>.<\/p>\n<p>According to <em>the Times<\/em>, the policy could disqualify applicants from the hiring process even if they didn\u2019t participate in controversial chants or rally cries. Simply being present at a protest could warrant scrutiny, and an applicant found to have been at a protest may have to explain to the firm whether they did anything to moderate the behavior of those around them, according to the <em>Times<\/em>.\u00a0<\/p>\n<p>Gadeir Abbas, an attorney at the Council on American-Islamic Relations, told <em>Fortune<\/em> that the new policy was \u201cobjectionable.\u201d<\/p>\n<p>\u201cWhat Sullivan &amp; Cromwell is doing is they\u2019re creating the foundations for future blacklists that will say more about Sullivan &amp; Cromwell than it will about the kids and students that they\u2019re targeting,\u201d he said.\u00a0<\/p>\n<p>Abbas also said the policy may constitute a violation of Title VII, a provision of civil rights law that prohibits discrimination based on race, ethnicity, and nationality.\u00a0<\/p>\n<p><a href=\"https:\/\/www.nyclu.org\/resources\/know-your-rights\/speaking-out-public-employee\" target=\"_blank\" aria-label=\"Go to https:\/\/www.nyclu.org\/resources\/know-your-rights\/speaking-out-public-employee\" rel=\"noopener\" class=\"sc-80b85506-0 pUpMT\">Private employees have fewer free speech protections than those at public institutions<\/a>. Firms like Sullivan &amp; Cromwell can make hiring decisions based on the publicly expressed beliefs of applicants, provided they don\u2019t specifically discriminate against protected categories like race or religion.\u00a0<\/p>\n<p>But because of the breadth of the new policy Sullivan &amp; Cromwell is pursuing, Abbas said it may constitute illegal discrimination against Muslims and Palestinians.\u00a0<\/p>\n<p>\u201cLaw students and people that may apply to Sullivan &amp; Cromwell, some of them are going to be Palestinian, some of them are going to be Arab or Muslim,\u201d he told <em>Fortune<\/em>. \u201cAnd because we\u2019re talking about a genocide, there\u2019s something racial about that kind of crime. It\u2019s just the case that the opposition to the destruction of Palestinians arises inexorably from a person\u2019s ancestry. If you\u2019re Palestinian, you\u2019re going to be opposed to it.\u201d\u00a0<\/p>\n<p>A <a href=\"https:\/\/news.un.org\/en\/story\/2024\/03\/1147976\" target=\"_blank\" aria-label=\"Go to https:\/\/news.un.org\/en\/story\/2024\/03\/1147976\" rel=\"noopener\" class=\"sc-80b85506-0 pUpMT\">UN human rights expert has called<\/a> Israel\u2019s protracted assault on Gaza genocide, but the <a href=\"https:\/\/www.reuters.com\/world\/biden-whats-happening-gaza-is-not-genocide-2024-05-20\/\" target=\"_blank\" aria-label=\"Go to https:\/\/www.reuters.com\/world\/biden-whats-happening-gaza-is-not-genocide-2024-05-20\/\" rel=\"noopener\" class=\"sc-80b85506-0 pUpMT\">Biden Administration has not<\/a>.\u00a0<\/p>\n<p>But Shenker told <em>the Times<\/em> that the policy wasn\u2019t inherently condemning protests against Israel in general, or scrutinizing privately held beliefs. Rather, the background checks were merely an extension of the firm\u2019s existing position on hate speech. He also said that the screenings wouldn\u2019t have been necessary if schools had done more from the outset to protect Jewish students and clamp down on anti-semitic demonstrations.\u00a0<\/p>\n<p>Dylan Saba, an attorney at Palestine Legal, told <em>Fortune<\/em> that the level of scrutiny the policy would subject applicants to was so \u201cdraconian,\u201d that he didn\u2019t see how the firm would be able to enforce it without running afoul of Title VII of the Civil Rights Act.\u00a0<\/p>\n<p>\u201cMy charitable assessment is that this is mostly for PR,\u201d Saba said. \u201cThey want to signal to some group of people that they\u2019re really out in front of stamping out criticism of Israel and pro-Palestine views.\u201d<\/p>\n<p>Sullivan &amp; Cromwell did not respond to Fortune\u2019s request for comment.\u00a0<\/p>\n<p>For many law firms, the thorny issue of student protesters has been a concern almost since theOct. 7 Hamas terrorist attack on Israel. Shenker wrote <a href=\"https:\/\/www.sullcrom.com\/SullivanCromwell\/_Assets\/PDFs\/General\/Letter-to-Law-School-Deans.pdf\" target=\"_blank\" aria-label=\"Go to https:\/\/www.sullcrom.com\/SullivanCromwell\/_Assets\/PDFs\/General\/Letter-to-Law-School-Deans.pdf\" rel=\"noopener\" class=\"sc-80b85506-0 pUpMT\">an open letter<\/a> to law school deans pressuring them to rein in the more extreme demonstrations that had begun popping up on campuses. The letter was signed by around 200 other firms.\u00a0<\/p>\n<p>While S&amp;C is the first firm to come out with a formal policy towards the protesters, it isn\u2019t the first to factor the demonstrations into their hiring practices. Last year, <a href=\"https:\/\/www.nytimes.com\/2023\/10\/17\/business\/davis-polk-employment-columbia-harvard-israel-palestine.html\" target=\"_blank\" aria-label=\"Go to https:\/\/www.nytimes.com\/2023\/10\/17\/business\/davis-polk-employment-columbia-harvard-israel-palestine.html\" rel=\"noopener\" class=\"sc-80b85506-0 pUpMT\">Davis Polk rescinded offers to three students<\/a> believed to have led demonstrations blaming Israel for the Oct. 7 attack, and <a href=\"https:\/\/news.bloomberglaw.com\/business-and-practice\/winston-scraps-nyu-law-students-job-offer-over-israel-email\" target=\"_blank\" aria-label=\"Go to https:\/\/news.bloomberglaw.com\/business-and-practice\/winston-scraps-nyu-law-students-job-offer-over-israel-email\" rel=\"noopener\" class=\"sc-80b85506-0 pUpMT\">Winston &amp; Strawn pulled an offer<\/a> to a student who expressed a similar sentiment in a school newsletter.\u00a0<\/p>\n<p>The <em>Times<\/em> also reported that several of S&amp;C\u2019s competitors are privately mulling similar policies.\u00a0<\/p>\n<p>\u201cYou expect law firms to understand that if we\u2019re going to have a profession filled with smart, independent-minded people who are fierce advocates, many of them are going to speak out against the genocide,\u201d Abbas said. \u201cIf you disagree with them, that\u2019s fine, but you shouldn\u2019t exclude them from the profession, as Sullivan &amp; Cromwell seemingly is trying to do.\u201d<\/p>\n<p>Public outrage against Israel\u2019s conduct in the assault in Gaza, which reached an inflection point this spring with <a href=\"https:\/\/fortune.com\/2024\/04\/29\/college-campus-protests-gaza-columbia-arrests-suspensions-permanent-record\/\" target=\"_self\" aria-label=\"Go to https:\/\/fortune.com\/2024\/04\/29\/college-campus-protests-gaza-columbia-arrests-suspensions-permanent-record\/\" class=\"sc-80b85506-0 pUpMT\" rel=\"noopener\">mass arrests on campuses across the country<\/a>, has now spread to Corporate America. Since early June, a crowd of protesters <a href=\"https:\/\/fortune.com\/2024\/06\/26\/citi-management-climate-antiwar-protests-outside-hq-fever-pitch\/\" target=\"_self\" aria-label=\"Go to https:\/\/fortune.com\/2024\/06\/26\/citi-management-climate-antiwar-protests-outside-hq-fever-pitch\/\" class=\"sc-80b85506-0 pUpMT\" rel=\"noopener\">have gathered outside Citigroup\u2019s headquarters in New York City<\/a> over the financial institution\u2019s ties to Israel.\u00a0<\/p>\n<p>In a recent survey of more than 600 pro-Palestine student activists, nearly 30% of respondents indicated that they had a job offer rescinded in the last six months, <a href=\"https:\/\/www.intelligent.com\/3-in-10-pro-palestine-student-activists-had-a-job-offer-rescinded-in-the-last-six-months\/\" target=\"_blank\" aria-label=\"Go to https:\/\/www.intelligent.com\/3-in-10-pro-palestine-student-activists-had-a-job-offer-rescinded-in-the-last-six-months\/\" rel=\"noopener\" class=\"sc-80b85506-0 pUpMT\">according to the education news outlet <em>Intelligent<\/em><\/a>.
