But a new law in Illinois will require them to hand over a share of their revenues to their young costars moving forward.<\/p>\n<div class=\"paywall\">\n<p>The state, on July 1, <a href=\"https:\/\/www.rollingstone.com\/culture\/culture-news\/illinois-child-influencer-law-1235053914\/\" target=\"_blank\" aria-label=\"Go to https:\/\/www.rollingstone.com\/culture\/culture-news\/illinois-child-influencer-law-1235053914\/\" rel=\"noopener\" class=\"sc-80b85506-0 pUpMT\">enacted new rules<\/a> to its Child Labor Law, requiring adults to pay children under the age of 16 if those minors appear in at least 30% of their social media content over a 30-day period. Those funds must be placed into a trust, which the minor can access at the age of 18.<\/p>\n<p>Parents who fail to do so can be sued by their children, according to the law.<\/p>\n<p>While there are laws in place to protect children from professional film and television productions, there have not been any in place before this to protect those who are part of the online worlds. That gap has remained as a growing number of children become part of the influencer economy.<\/p>\n<p>Illinois was the first state to pass these protections, but it may not be the last. Maryland, California, and Wisconsin are also said to be considering similar legislation.<\/p>\n<p>\u201cThe rise of social media has given children new opportunities to earn a profit,\u201d said Illinois State Senator Dave Koehler (D-Peoria) <a href=\"https:\/\/www.senatordavekoehler.com\/news\/28-press-releases\/462-koehler-law-ensures-child-vloggers-are-accurately-compensated\" target=\"_blank\" aria-label=\"Go to https:\/\/www.senatordavekoehler.com\/news\/28-press-releases\/462-koehler-law-ensures-child-vloggers-are-accurately-compensated\" rel=\"noopener\" class=\"sc-80b85506-0 pUpMT\">in a statement<\/a> when the bill passed. \u201cMany parents have taken this opportunity to pocket the money, while making their children continue to work in these digital environments.\u201d<\/p>\n<p>A <a href=\"https:\/\/www.youtube.com\/watch?v=8XkaSouYTbg\" target=\"_blank\" aria-label=\"Go to https:\/\/www.youtube.com\/watch?v=8XkaSouYTbg\" rel=\"noopener\" class=\"sc-80b85506-0 pUpMT\">2019 report from CBS<\/a> found \u201c<a href=\"https:\/\/fortune.com\/2019\/03\/23\/youtube-influencers-kids-marketing\/\" target=\"_self\" aria-label=\"Go to https:\/\/fortune.com\/2019\/03\/23\/youtube-influencers-kids-marketing\/\" class=\"sc-80b85506-0 pUpMT\" rel=\"noopener\">kidfluencers<\/a>\u201d can make as much as $10,000 per sponsored post. But the money <a href=\"https:\/\/fortune.com\/2023\/01\/18\/influencers-children-social-media-laws-sponsored-content-sharenting\/\" target=\"_self\" aria-label=\"Go to https:\/\/fortune.com\/2023\/01\/18\/influencers-children-social-media-laws-sponsored-content-sharenting\/\" class=\"sc-80b85506-0 pUpMT\" rel=\"noopener\">goes to the account holder<\/a> and, due to age restrictions on those platforms, that\u2019s the parent or guardian.<\/p>\n<p>The vloggers are responsible for maintaining records of their young costars\u2019 appearances.
