It\u2019s not an all-out ban on the technology, though, and the court\u2019s jurisdiction to enforce the agreement only extends four years. Under the new restrictions, which the <a data-i13n=\"elm:context_link;elmt:doNotAffiliate;cpos:1;pos:1\" class=\"link \" href=\"https:\/\/www.aclumich.org\/en\/press-releases\/civil-rights-advocates-achieve-nations-strongest-police-department-policy-facial\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:ACLU;elm:context_link;elmt:doNotAffiliate;cpos:1;pos:1;itc:0;sec:content-canvas\"><\/a> is calling the strongest such policies for law enforcement in the country, police cannot make arrests based solely on facial recognition results or conduct a lineup based only on facial recognition leads.<\/p>\n<p>Williams was <a data-i13n=\"elm:context_link;elmt:doNotAffiliate;cpos:2;pos:1\" class=\"link \" href=\"https:\/\/www.engadget.com\/facial-recognition-wrongful-arrest-michigan-141531393.html\" data-ylk=\"slk:arrested after facial recognition technology flagged;elm:context_link;elmt:doNotAffiliate;cpos:2;pos:1;itc:0;sec:content-canvas\">arrested after facial recognition technology flagged<\/a> his expired driver\u2019s license photo as a possible match for the identity of an alleged shoplifter, which police then used to construct a photo lineup. He was arrested at his home, in front of his family, which he says \u201ccompletely upended my life.\u201d Detroit PD is known to have made at least two <a data-i13n=\"elm:context_link;elmt:doNotAffiliate;cpos:3;pos:1\" class=\"link \" href=\"https:\/\/www.engadget.com\/facial-recognition-false-match-wrongful-arrest-224053761.html\" data-ylk=\"slk:other wrongful arrests based on the results of facial recognition;elm:context_link;elmt:doNotAffiliate;cpos:3;pos:1;itc:0;sec:content-canvas\">other wrongful arrests based on the results of facial recognition<\/a> technology (FRT), and in both cases, the victims were Black, the ACLU noted in its announcement of the settlement. Studies have shown that facial recognition is <a data-i13n=\"cpos:4;pos:1\" href=\"https:\/\/www.engadget.com\/2019-12-20-nist-face-recognition-bias-study.html\" data-ylk=\"slk:more likely to misidentify people of color;cpos:4;pos:1;elm:context_link;itc:0;sec:content-canvas\" class=\"link \"><\/a>.<\/p>\n<p>The new rules stipulate that \u201c[a]n FRT lead, combined with a lineup identification, may never be a sufficient basis for seeking an arrest warrant,\u201d according to a summary of the agreement.
