This is the latest in a long line of lawsuits filed by publishers and creators accusing generative AI companies of violating copyright.<\/p>\n<p>\u201cOpenAI and Microsoft started vacuuming up our stories to make their product more powerful, but they never asked for permission or offered compensation, unlike other organizations that license our material,\u201d said Monika Bauerlein, CEO of the Center for Investigative Reporting, in a <a data-i13n=\"elm:context_link;elmt:doNotAffiliate;cpos:1;pos:1\" class=\"link \" href=\"https:\/\/www.motherjones.com\/press-releases\/cir-sues-openai\/\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:statement;elm:context_link;elmt:doNotAffiliate;cpos:1;pos:1;itc:0;sec:content-canvas\">statement<\/a>. \u201cThis free rider behavior is not only unfair, it is a violation of copyright. The work of journalists, at CIR and everywhere, is valuable, and OpenAI and Microsoft know it.\u201d Bauerlein said that OpenAI and Microsoft treat the work of nonprofit and independent publishers \u201cas free raw material for their products,&#8221; and added that such moves by generative AI companies hurt the public\u2019s access to truthful information in a \u201cdisappearing news landscape.\u201d<\/p>\n<p>OpenAI and Microsoft did not respond to a request for comment by Engadget.<\/p>\n<p>The CIR\u2019s<a data-i13n=\"elm:context_link;elmt:doNotAffiliate;cpos:2;pos:1\" class=\"link \" href=\"https:\/\/www.motherjones.com\/wp-content\/uploads\/2024\/06\/CIR_Lawsuit_Against-OpenAI_06.27.24.pdf\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:lawsuit;elm:context_link;elmt:doNotAffiliate;cpos:2;pos:1;itc:0;sec:content-canvas\"> lawsuit<\/a>, which was filed in Manhattan\u2019s federal court, accuses OpenAI and Microsoft, which owns nearly half of the company, of violating the Copyright Act and the Digital Millennium Copyright Act multiple times.<\/p>\n<p>News organizations find themselves at an inflection point with generative AI. While the CIR is <a data-i13n=\"cpos:3;pos:1\" href=\"https:\/\/www.engadget.com\/the-new-york-times-is-suing-openai-and-microsoft-for-copyright-infringement-181212615.html\" data-ylk=\"slk:joining;cpos:3;pos:1;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">joining<\/a> publishers like <em>The New York Times<\/em>, <em>New York Daily News<\/em>, <em>The Intercept<\/em>, <em>AlterNet<\/em> and <em>Chicago Tribune<\/em> in suing OpenAI, others publishers have chosen to strike licensing deals with the company. These deals will allow OpenAI to train its models on archives and ongoing content published by these publishers and cite information from them in responses offered by ChatGPT.<\/p>\n<p>On the same day as the CIR sued OpenAI, for instance, <em>TIME<\/em> magazine <a data-i13n=\"elm:context_link;elmt:doNotAffiliate;cpos:4;pos:1\" class=\"link \" href=\"https:\/\/www.engadget.com\/time-strikes-a-deal-to-funnel-101-years-of-journalism-into-openais-gaping-maw-144058426.html\" data-ylk=\"slk:announced;elm:context_link;elmt:doNotAffiliate;cpos:4;pos:1;itc:0;sec:content-canvas\">announced<\/a> a deal with the company that would grant it access to 101 years of archives. Last month, OpenAI <a data-i13n=\"elm:context_link;elmt:doNotAffiliate;cpos:5;pos:1\" class=\"link \" href=\"https:\/\/www.engadget.com\/openai-will-reportedly-pay-250-million-to-put-news-corps-journalism-in-chatgpt-214615249.html\" data-ylk=\"slk:signed;elm:context_link;elmt:doNotAffiliate;cpos:5;pos:1;itc:0;sec:content-canvas\">signed<\/a> a $250 million multi-year deal with News Corp, the owner of <em>The Wall Street Journal<\/em>, to train its models on more than a dozen brands owned by the publisher.
