This story gets crazy even in a town known for its unmatched level of crazy.<\/p>\n<p>The lawsuit by Niko Samarxhiu against bonehead Ben Ralph is asking for at least $2 million in damages, and we\u2019ve got all the details, exclusively.<\/p>\n<figure id=\"attachment_40504\" aria-describedby=\"caption-attachment-40504\" style=\"width: 845px\" class=\"wp-caption aligncenter\"><img fetchpriority=\"high\" fetchpriority=\"high\" decoding=\"async\" class=\"lazyload wp-image-40504 size-post-thumbnail-crop-845xAUTO\" style=\"border: 1px solid #000000;\" alt=\"\" width=\"845\" height=\"563\" src=\"https:\/\/www.casino.org\/vitalvegas\/wp-content\/uploads\/2024\/06\/sued-845x563.jpg\"\/><figcaption id=\"caption-attachment-40504\" class=\"wp-caption-text\">Some things, money can\u2019t buy. Even in Vegas.<\/figcaption><\/figure>\n<p>This is the part where we remind you <a href=\"https:\/\/www.casino.org\/vitalvegas\/high-rollers-tantrum-sparks-bizarre-nightlife-drama\" target=\"_blank\" rel=\"noopener\">we broke news of the original WTF<\/a>\u00a0back in 2023, and it probably would never have been a thing if we hadn\u2019t.<\/p>\n<p>There\u2019s a lot of backstory, but nobody has time to read all that, so here\u2019s the short version.<\/p>\n<p>Ben Ralph, described as a \u201ctrust fund baby,\u201d spent the day partying at Wynn\u2019s Encore Beach Club. He then demanded XS Nightclub open early just for him. The manager of XS, Niko Samarxhiu, said no.\u00a0\u201cNo\u201d is not something wealthy, entitled nimrods are used to hearing in Las Vegas.<\/p>\n<p>Ben Ralph promptly went nuts. He taunted Samarxhiu with profanity-laced texts and racist social media posts, and threatened to take his business elsewhere if Samarxhiu wasn\u2019t fired.<\/p>\n<p>Firing people because of hissy fits isn\u2019t how things world in the real world, so Ralph went to nearby Resorts World. Once there, he convinced the staff at Zouk nightclub to put personal messages on the hotel\u2019s massive screen (a perk afforded to big spenders in the club, sorry, once afforded big spenders, you\u2019ll see).<\/p>\n<p>One message taunted Wynn for having taken his business across the street. The screen faces Wynn.<\/p>\n<figure id=\"attachment_40499\" aria-describedby=\"caption-attachment-40499\" style=\"width: 845px\" class=\"wp-caption aligncenter\"><img decoding=\"async\" class=\"lazyload wp-image-40499 size-post-thumbnail-crop-845xAUTO\" style=\"border: 1px solid #000000;\" alt=\"\" width=\"845\" height=\"563\" src=\"https:\/\/www.casino.org\/vitalvegas\/wp-content\/uploads\/2024\/06\/house1-2-845x563.jpg\"\/><figcaption id=\"caption-attachment-40499\" class=\"wp-caption-text\">Ben dover, you\u2019re about the learn the meaning of \u201caccountability.\u201d<\/figcaption><\/figure>\n<p>Ralph also taunted Niko Samarxhiu, personally, via the Resorts World screen.<\/p>\n<p>The message: \u201cFood Stamps for Niko.\u201d The subtext: Samarxhiu was out of work or soon would be, presumably due to the sheer enormity of Ben Ralph\u2019s man-child dickishness.<\/p>\n<figure id=\"attachment_40500\" aria-describedby=\"caption-attachment-40500\" style=\"width: 845px\" class=\"wp-caption aligncenter\"><img loading=\"lazy\" loading=\"lazy\" decoding=\"async\" class=\"lazyload wp-image-40500 size-post-thumbnail-crop-845xAUTO\" style=\"border: 1px solid #000000;\" alt=\"\" width=\"845\" height=\"563\" src=\"https:\/\/www.casino.org\/vitalvegas\/wp-content\/uploads\/2024\/06\/food1-845x563.jpg\"\/><figcaption id=\"caption-attachment-40500\" class=\"wp-caption-text\">We aren\u2019t dealing with a MENSA member here.<\/figcaption><\/figure>\n<p>Surreal and beyond the pale, especially given the fact Ralph threatened the life of Samarxhiu and his family.<\/p>\n<p>Rumors at the time were Wynn contacted the authorities and law enforcement pursued the incident, results unclear.<\/p>\n<p>After our story was published, Resorts World issued a statement: \u201cThe LED sign on the West Tower was activated on Saturday night with a graphic requested by a nightlife patron. The team members who approved it were not aware of the background behind the request. Regardless, this was a mistake, and the messaging displayed does not reflect Resorts World Las Vegas\u2019s values, and we regret that our LED screen was misused in this manner. Our leadership is handling this internally to ensure the assets displayed on the LED screens are in full alignment with the brand and our values.\u201d<\/p>\n<p>It was difficult to stomach that statement at the time, but given more recent events, it\u2019s even more awkward.<\/p>\n<p>Brand values?<\/p>\n<p>You mean the values where the former Resorts World president, Scott Sibella, pled guilty to a <a href=\"https:\/\/www.justice.gov\/usao-cdca\/pr\/former-president-mgm-grand-pleads-guilty-violating-bank-secrecy-act-allowing-man\" target=\"_blank\" rel=\"noopener\">federal criminal charge<\/a> (just the one!) for failing to file reports of suspicious transactions his casino was required to make pursuant to the Bank Secrecy Act?<\/p>\n<p>Or the other values where Resorts World <a href=\"https:\/\/nevadacurrent.com\/2024\/05\/22\/resorts-world-could-face-massive-fines-in-alleged-money-laundering-case\" target=\"_blank\" rel=\"noopener\">could face massive fines<\/a> in an alleged money laundering case?<\/p>\n<p>Anyhoo, fast forward to today.<\/p>\n<p>Niko Samarxhiu is represented by Brownstein Hyatt Farber Schreck, a well-known law firm in Las Vegas. <a href=\"https:\/\/www.casino.org\/vitalvegas\/wp-content\/uploads\/2024\/06\/2024.06.07-Complaint-for-Damages.pdf\" target=\"_blank\" rel=\"noopener\">We got our hands on the Complaint<\/a> (.pdf), and you can read the entire thing if you\u2019re bored.<\/p>\n<figure id=\"attachment_40503\" aria-describedby=\"caption-attachment-40503\" style=\"width: 845px\" class=\"wp-caption aligncenter\"><img loading=\"lazy\" loading=\"lazy\" decoding=\"async\" class=\"lazyload wp-image-40503 size-post-thumbnail-crop-845xAUTO\" style=\"border: 1px solid #000000;\" alt=\"\" width=\"845\" height=\"1122\" src=\"https:\/\/www.casino.org\/vitalvegas\/wp-content\/uploads\/2024\/06\/niko_lawsuit-845x1122.jpg\"\/><figcaption id=\"caption-attachment-40503\" class=\"wp-caption-text\">Not to overwhelm you with legal jargon, but this is called the \u201cfinding out\u201d phase of a lawsuit.<\/figcaption><\/figure>\n<p>The Complaint is, refreshingly, written in human English, unlike most legal documents. We especially like the way the Complaint has an undertone of calling Ben Ralph an asshole, but without coming right out and saying it. Lawyers can\u2019t really do that. We can, because it\u2019s our opinion. We love you, First Amendment.<\/p>\n<p>The lawsuit confirms Ben Ralph was, indeed, arrested for \u201cterroristic threatening.\u201d That\u2019s the legal term for when somebody tries to \u201cterrorize\u201d someone through threats of violence, the threat typically has to be imminent. Terroristic threats can be written, oral or physical. The other kind of terrorism, prevented by taking one\u2019s belt and shoes off at airports, is something else.<\/p>\n<p>The Complaint contains some texts with colorful language, all supporting the assertion Ben Ralph is a despicable human being, and we\u2019re using the term \u201chuman being\u201d very loosely here. We\u2019re mainly including this page of the lawsuit because when the Las Vegas Review-Journal takes our story and writes about it (without attribution, of course), they will bleep out these parts.<\/p>\n<figure id=\"attachment_40517\" aria-describedby=\"caption-attachment-40517\" style=\"width: 845px\" class=\"wp-caption aligncenter\"><img loading=\"lazy\" loading=\"lazy\" decoding=\"async\" class=\"lazyload wp-image-40517 size-post-thumbnail-crop-845xAUTO\" style=\"border: 1px solid #000000;\" alt=\"\" width=\"845\" height=\"1122\" src=\"https:\/\/www.casino.org\/vitalvegas\/wp-content\/uploads\/2024\/06\/niko_lawsuit2-845x1122.jpg\"\/><figcaption id=\"caption-attachment-40517\" class=\"wp-caption-text\">Some people should never be allowed to procreate.<\/figcaption><\/figure>\n<p>At one point, Ralph threatens to send his \u201cDad\u2019s enforcer\u201d to visit Samarxhiu. The term \u201cenforcer\u201d is described as \u201cunambiguous\u201d in the lawsuit. We agree. The only people who use this term have unambiguously small penises.<\/p>\n<p>Our favorite part of the Complaint is on page 11. Item number 36 mentions our immense social media reach, and 48 includes a particularly eloquent and incisive quote from a Las Vegas blog of note.<\/p>\n<figure id=\"attachment_40501\" aria-describedby=\"caption-attachment-40501\" style=\"width: 845px\" class=\"wp-caption aligncenter\"><img loading=\"lazy\" loading=\"lazy\" decoding=\"async\" class=\"lazyload wp-image-40501 size-post-thumbnail-crop-845xAUTO\" style=\"border: 1px solid #000000;\" alt=\"\" width=\"845\" height=\"563\" src=\"https:\/\/www.casino.org\/vitalvegas\/wp-content\/uploads\/2024\/06\/niko_lawsuit1-845x563.jpg\"\/><figcaption id=\"caption-attachment-40501\" class=\"wp-caption-text\">Our fighting for the underdog isn\u2019t contingent upon Tweet impressions, but we certainly don\u2019t get mad when we get them.<\/figcaption><\/figure>\n<p>Yes, a couple of our Tweets about this kerfuffle got more than 1.5 million impressions. Not that we have to make everything about us. Just because we brought an injustice to the attention of the public, selflessly sacrificing our afternoon to write a story that has resulted in a moron getting his comeuppance. That\u2019s just who we are.<\/p>\n<p>That quote is from our blog, too. It resulted in Resorts World and Zouk changing their policy to avoid such shameful shenanigans in the future. If our selflessness seems boundless, we are not going to disagree with your assessment. If this level of generosity inspires you to DM us nudes, again, what selfless person would discourage such an act of self-expression?<\/p>\n<p>Back to the lawsuit!<\/p>\n<p>The smoothest move in the lawsuit has to be this item: \u201cWhile Resorts World says that its decision to enable some of Ben\u2019s attacks \u2018was a mistake\u2019 and did not \u2018reflect Resorts World\u2019s values,\u2019 Resorts World was apparently happy to keep the $200,000 they received for their part in Ben\u2019s campaign of intimidation and harassment. The company certainly did not give any of the money they were paid (for what they claim to have been a \u2018mistake\u2019) to their victim\u2014Niko.\u201d<\/p>\n<p>As our fellow youths and their attorneys say, \u201cBoom.\u201d<\/p>\n<p>There are two claims for relief: 1) Intentional Infliction of Emotional Distress, and 2) False Light Invasion of Privacy. No, being an idiot isn\u2019t against the law. We\u2019d need much bigger prisons.<\/p>\n<p>The relief sought by Samarxhiu and his lawyer? 1) An award of damages according to proof, but not less than $2,000,000. 2) An award of punitive damages according to proof. 3) Any further relief the Court deems to be just and proper. 5) An award of costs.<\/p>\n<p>We misnumbered those intentionally just so see if you\u2019re skimming. We know how you are.<\/p>\n<p>Which means the rich guy\u2019s daddy will hire an attorney to negotiate a settlement, the over\/under is a cool million, and Niko Samarxhiu\u2019s kids will get to go to expensive colleges.<\/p>\n<p>We love a happy ending, and Niko Samarxhiu has the receipts.<\/p>\n<p>The doofus, Ben Ralph, and his high-priced lawyers will claim Ralph was drunk after partying all day and was just joking. The claim will be his threats shouldn\u2019t have been taken seriously because his texts and social media posts appear to have been written by someone with severe head trauma. Ralph may also take a shot at the \u201cI\u2019m in Australia, neener-neener-neener defense.\u201d The lawsuit says Ralph is an Australian citizen but lives in California. Fleeing the country is a common strategy when jerkwads are faced with legal challenges. See also Roman Polanski and possibly Puffy, or whatever he\u2019s called now.<\/p>\n<p>Once the lawyers see how this case goes, they can take a look at whether Resorts World is complicit in what happened, and don\u2019t be surprised if Resorts World gets slapped with a lawsuit, too.<\/p>\n<p>Resorts World must not have run their statement by their lawyers, because it says \u201cmistake\u201d in it.
