It\u2019s one of the most severe punishments ever for white-collar crime\u2014and caps the biggest financial fraud case in the country\u2019s history, with total damages amounting to the equivalent of 3% of the country\u2019s GDP. The 67-year-old chairwoman of real estate company Van Thinh Phat Group was arrested in 2022, facing charges that include bribery of government officials and violation of bank lending rules. In<\/p>\n<div>\n<p>The charges echo the epic collapses of other real-estate fortunes in some of Asia\u2019s largest economies, particularly China. There\u2019s <a href=\"https:\/\/fortune.com\/company\/country-garden-holdings\/\" target=\"_blank\" rel=\"noopener\" class=\"sc-d963e821-0 eclfSM  \">Country Garden Holdings<\/a> chairwoman Yang Huiyan, for instance, whose company<a href=\"https:\/\/www.bbc.com\/news\/business-68710728\" target=\"_blank\" rel=\"noopener\" class=\"sc-d963e821-0 eclfSM  \"> suspended shares<\/a> last week following its<a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2023-10-25\/country-garden-default-on-dollar-bond-declared-for-first-time\" target=\"_blank\" rel=\"noopener\" class=\"sc-d963e821-0 eclfSM  \"> default<\/a> on overseas debt in October of last year as just the latest developments in its deepening <a href=\"https:\/\/www.nytimes.com\/2023\/10\/19\/business\/country-garden-bond-payment.html\" target=\"_blank\" rel=\"noopener\" class=\"sc-d963e821-0 eclfSM  \">debt crisis.<\/a> When the company missed its overseas debt payment, it had <a href=\"https:\/\/www.nytimes.com\/2023\/10\/19\/business\/country-garden-bond-payment.html\" target=\"_blank\" rel=\"noopener\" class=\"sc-d963e821-0 eclfSM  \">$187 billion<\/a> in liabilities, and had been unloading assets and selling shares to stave off its debt obligations for months. In November, Country Garden said it needed to repay nearly $15 billion in debt within the next 12 months, while disclosing a $7.1 billion loss for the first six months of the year.<\/p>\n<p>Its rival real estate group, Evergrande, led by CEO Hui Ka Yan, <a href=\"https:\/\/www.nytimes.com\/2023\/08\/17\/business\/china-evergrande-bankruptcy.html\" target=\"_blank\" rel=\"noopener\" class=\"sc-d963e821-0 eclfSM  \">filed for bankruptcy protection<\/a> last August, while <a href=\"https:\/\/fortune.com\/asia\/2024\/03\/19\/csrc-alleges-evergrande-hui-ka-yan-inflate-sales-revenue-china-real-estate-crisis\/\" target=\"_self\" rel=\"noopener\" class=\"sc-d963e821-0 eclfSM  \">China\u2019s securities regulator<\/a> hit the property giant with a <a href=\"https:\/\/fortune.com\/asia\/2024\/03\/19\/csrc-alleges-evergrande-hui-ka-yan-inflate-sales-revenue-china-real-estate-crisis\/?utm_source=search&amp;utm_medium=suggested_search&amp;utm_campaign=search_link_clicks\" target=\"_self\" rel=\"noopener\" class=\"sc-d963e821-0 eclfSM  \">$78 billion fraud<\/a> accusation for <a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2024-03-18\/china-fines-evergrande-s-hui-and-bans-him-from-market?srnd=homepage-asia&amp;sref=nfBouUGg\" target=\"_blank\" rel=\"noopener\" class=\"sc-d963e821-0 eclfSM  \">inflating its revenue<\/a> from 2019 through 2020. It\u2019s one of the largest fraud cases in the country\u2019s history. The CEO was arrested last September on suspicion of financial crimes, Evergrande said in <a href=\"https:\/\/www1.hkexnews.hk\/listedco\/listconews\/sehk\/2023\/0929\/2023092801875.pdf\" target=\"_blank\" rel=\"noopener\" class=\"sc-d963e821-0 eclfSM  \">a filing<\/a> to the Hong Kong stock exchange.<\/p>\n<p>The biggest charge against My Lan was embezzling funds from Saigon Commercial Bank (SCB) between February 2018 and October 2022. The five-week trial was conducted under tight security at the Ho Chi Minh City People\u2019s Court, where more than<a href=\"https:\/\/www.cnbc.com\/2024\/04\/11\/vietnamese-property-tycoon-sentenced-to-death-in-financial-fraud-case.html\" target=\"_blank\" rel=\"noopener\" class=\"sc-d963e821-0 eclfSM  \"> 80 other people<\/a> including central bank officials have been charged in the case, including My Lan\u2019s<a href=\"https:\/\/www.bbc.com\/news\/world-asia-68778636\" target=\"_blank\" rel=\"noopener\" class=\"sc-d963e821-0 eclfSM  \"> husband and niece<\/a>.<\/p>\n<p>My Lan embezzled about<a href=\"https:\/\/fortune.com\/2024\/04\/11\/truong-my-lan-sentenced-to-death-12-billion-fraud\/?utm_source=search&amp;utm_medium=suggested_search&amp;utm_campaign=search_link_clicks\" target=\"_self\" rel=\"noopener\" class=\"sc-d963e821-0 eclfSM  \"> $12 billion<\/a>, and was convicted of taking out $44 billion in loans from the bank between 2012 and 2022, according to Vietnamese online newspaper<a href=\"https:\/\/e.vnexpress.net\/news\/business\/companies\/van-thinh-phat-chairwoman-truong-my-lan-deserves-toughest-sentence-court-4733025.html\" target=\"_blank\" rel=\"noopener\" class=\"sc-d963e821-0 eclfSM  \"> <em>VN Express<\/em><\/a>, accounting for more than 93% of the bank\u2019s lending during that period. The verdict requires her to return <a href=\"https:\/\/www.bbc.com\/news\/world-asia-68778636\" target=\"_blank\" rel=\"noopener\" class=\"sc-d963e821-0 eclfSM  \">$27 billion<\/a>, a sum that exceeds the market capitalization of most Vietnamese banks. It prompted panic among depositors of SCB, triggering a run on the bank and, ultimately, the State Bank of Vietnam taking control of the lender. Since Vietnam\u2019s criminal laws started applying embezzlement to non-government individuals in 2018,<a href=\"https:\/\/e.vnexpress.net\/news\/business\/companies\/van-thinh-phat-chairwoman-truong-my-lan-deserves-toughest-sentence-court-4733025.html\" target=\"_blank\" rel=\"noopener\" class=\"sc-d963e821-0 eclfSM  \"> <em>VN Express<\/em><\/a> reported, My Lan\u2019s actions have been classified under that charge.<\/p>\n<p>My Lan\u2019s defense lawyers <a href=\"https:\/\/www.cnbc.com\/2024\/04\/11\/vietnamese-property-tycoon-sentenced-to-death-in-financial-fraud-case.html\" target=\"_blank\" rel=\"noopener\" class=\"sc-d963e821-0 eclfSM  \">argued<\/a> that she only controlled about 15% of the bank, and that she did not have an official position there after a merger transaction in 2011. Court judges, however, found that Lan held a controlling stake of more than 90% of the bank through proxies.<\/p>\n<h2 class=\"wp-block-heading\"><strong>The ultra-rare white-collar death penalty sentence<\/strong><\/h2>\n<p>Still, the death penalty is a rare sentence for economic crimes, to say the least. One of the few other, also widely publicized death penalty convictions for a corruption charge was<a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2013-12-16\/vinalines-former-executives-sentenced-to-death-in-vietnam-trial\" target=\"_blank\" rel=\"noopener\" class=\"sc-d963e821-0 eclfSM  \"> in 2013<\/a>, after two former executives of Vietnam National<a href=\"https:\/\/fortune.com\/company\/china-cosco-shipping\/\" target=\"_self\" rel=\"noopener\" class=\"sc-d963e821-0 eclfSM  \"> Shipping<\/a> Lines were found guilty of embezzlement.<\/p>\n<p>In Vietnam, the<a href=\"https:\/\/worldcoalition.org\/document\/the-death-penalty-in-the-socialist-republic-of-vietnam-special-edition-for-the-4th-world-congress-against-the-death-penalty\/\" target=\"_blank\" rel=\"noopener\" class=\"sc-d963e821-0 eclfSM  \"> death penalty<\/a> can be awarded for 22 offenses, including murder, armed robbery, drug trafficking, rape, sexual abuse of children, and for economic crimes such as graft, corruption, fraud, and embezzlement. The majority of death sentences in the country are for drug-related crimes, according to<a href=\"https:\/\/www.amnesty.org\/en\/documents\/act50\/6548\/2023\/en\/\" target=\"_blank\" rel=\"noopener\" class=\"sc-d963e821-0 eclfSM  \"> Amnesty International<\/a>, which said in a 2023 report that more than 102 people received death sentences in 2022. The number of executions were unclear due to \u201csecrecy surrounding figures and limited access to information.\u201d And while a death sentence for embezzlement is rare, it doesn\u2019t take much to prompt it: embezzling as little as 500 million Vietnamese dong, or $20,000, from government funds can qualify for a death sentence, according to a <a href=\"https:\/\/www.washingtonpost.com\/world\/2024\/04\/11\/vietnam-truong-my-lan-death-sentence\/\" target=\"_blank\" rel=\"noopener\" class=\"sc-d963e821-0 eclfSM  \"><em>Washington Post<\/em> report<\/a>.\u00a0<\/p>\n<p>Vietnam is in the midst of a years-long<a href=\"https:\/\/apnews.com\/article\/vietnam-economy-president-corruption-10a73952a106a234540748cad9fdaae2\" target=\"_blank\" rel=\"noopener\" class=\"sc-d963e821-0 eclfSM  \"> anti-corruption campaign<\/a>, which has been<a href=\"https:\/\/thediplomat.com\/2023\/02\/vietnams-anti-corruption-drive-can-never-go-far-enough\/\" target=\"_blank\" rel=\"noopener\" class=\"sc-d963e821-0 eclfSM  \"> raging<\/a> since 2016 and led by Communist Party Secretary Nguyen Phu Trong. In fact, the Communist Party has named its  crackdown the \u201c<a href=\"https:\/\/economictimes.indiatimes.com\/news\/international\/world-news\/how-vietnams-real-estate-tycoon-got-caught-in-a-blazing-furnace-for-12-5-billion-fraud\/articleshow\/109241974.cms?from=mdr\" target=\"_blank\" rel=\"noopener\" class=\"sc-d963e821-0 eclfSM  \">blazing furnace<\/a>,\u201d for the party\u2019s intense focus on reducing the country\u2019s economic corruption. The campaign sparked<a href=\"https:\/\/apnews.com\/article\/vietnam-economy-president-corruption-10a73952a106a234540748cad9fdaae2\" target=\"_blank\" rel=\"noopener\" class=\"sc-d963e821-0 eclfSM  \"> resignations<\/a> from two of the nation\u2019s presidents in just two years, according to <em>the Associated Press<\/em>, and comes as the nation\u2019s been rising as a global supply chain hub for companies like <a href=\"https:\/\/fortune.com\/company\/apple\/\" target=\"_blank\" rel=\"noopener\" class=\"sc-d963e821-0 eclfSM  \">Apple<\/a> and <a href=\"https:\/\/fortune.com\/company\/samsung-life-insurance\/\" target=\"_blank\" rel=\"noopener\" class=\"sc-d963e821-0 eclfSM  \">Samsung<\/a> Electronics, with both tech giants <a href=\"https:\/\/vir.com.vn\/apple-relocates-11-manufacturing-units-to-vietnam-104942.html\" target=\"_blank\" rel=\"noopener\" class=\"sc-d963e821-0 eclfSM  \">relocating<\/a> <a href=\"https:\/\/www.forbes.com\/sites\/kevinomarah\/2023\/05\/11\/samsung-playing-the-long-game-on-manufacturing-in-vietnam\/?sh=693f7e9628bf\" target=\"_blank\" rel=\"noopener\" class=\"sc-d963e821-0 eclfSM  \">manufacturing<\/a> units to the country in the last year.\u00a0<\/p>\n<p>China\u2019s real estate industry has been devastated by the two major defaults. The <a href=\"https:\/\/www.imf.org\/en\/News\/Articles\/2024\/02\/02\/cf-chinas-real-estate-sector-managing-the-medium-term-slowdown?utm_source=www.resiclubanalytics.com&amp;utm_medium=referral&amp;utm_campaign=china-grapples-with-severe-housing-bust\" target=\"_blank\" rel=\"noopener\" class=\"sc-d963e821-0 eclfSM  \">IMF looked at the sector in February<\/a>, and contextualized the over 60% fall in housing starts (i.e., new construction) relative to pre-pandemic levels: \u201ca historically rapid pace only seen in the largest housing busts in cross-country experience in the last three decades.\u201d <a href=\"https:\/\/www.resiclubanalytics.com\/p\/china-grapples-severe-housing-bust\" target=\"_blank\" rel=\"noopener\" class=\"sc-d963e821-0 eclfSM  \"><em>ResiClub<\/em>\u2018s Lance Lambert reported<\/a> that America\u2019s housing slump pales in comparison to China\u2019s, with continuing sharp declines in home sales, home construction, and residential investment, and falling home prices, to boot.<\/p>\n<p>On April 2, real estate group Country Garden stated \u201cdue to the continuous volatility of the industry,\u201d the group\u2019s operating environment is \u201cbecoming increasingly complex,\u201d before<a href=\"https:\/\/www1.hkexnews.hk\/listedco\/listconews\/sehk\/2024\/0328\/2024032803492.pdf\" target=\"_blank\" rel=\"noopener\" class=\"sc-d963e821-0 eclfSM  \"> announcing<\/a> its earnings report would be delayed. <\/p>\n<p>In the aftermath of fraud allegations for Evergrande Group, the company\u2019s mainland business, Hengda Real Estate, was also <a href=\"https:\/\/www.bbc.com\/news\/business-68710728\" target=\"_blank\" rel=\"noopener\" class=\"sc-d963e821-0 eclfSM  \">fined $583.5 million<\/a>, and its CEO faces a potential lifelong ban from China\u2019s financial markets. It\u2019s also been<a href=\"https:\/\/fortune.com\/asia\/2024\/01\/28\/evergrande-liquidation-order-hong-kong-court-china-real-estate-crisis\/\" target=\"_self\" rel=\"noopener\" class=\"sc-d963e821-0 eclfSM  \"> ordered by a Hong Kong court to liquidate<\/a>, and Chinese authorities recently began<a href=\"https:\/\/fortune.com\/asia\/2024\/03\/22\/china-investigating-role-big-4-accountant-pwc-78-billion-evergrande-fraud-case\/\" target=\"_self\" rel=\"noopener\" class=\"sc-d963e821-0 eclfSM  \"> examining<\/a> the role of <a href=\"https:\/\/fortune.com\/company\/pricewaterhousecoopers\/\" target=\"_blank\" rel=\"noopener\" class=\"sc-d963e821-0 eclfSM  \">PricewaterhouseCoopers<\/a> LLP in China in regards to Evergrande Group\u2019s accounting practices.\u00a0<\/p>\n<p>And the bad news for property giants keeps coming.
