{"id":213168,"date":"2024-03-14T00:30:55","date_gmt":"2024-03-14T00:30:55","guid":{"rendered":"https:\/\/michigandigitalnews.com\/index.php\/2024\/03\/14\/congress-push-to-outlaw-tiktok-follows-years-of-concern-from-elected-officials-about-chinese-election-interference-and-espionage\/"},"modified":"2025-06-25T17:20:40","modified_gmt":"2025-06-25T17:20:40","slug":"congress-push-to-outlaw-tiktok-follows-years-of-concern-from-elected-officials-about-chinese-election-interference-and-espionage","status":"publish","type":"post","link":"https:\/\/michigandigitalnews.com\/index.php\/2024\/03\/14\/congress-push-to-outlaw-tiktok-follows-years-of-concern-from-elected-officials-about-chinese-election-interference-and-espionage\/","title":{"rendered":"Congress\u2019 push to outlaw TikTok follows years of concern from elected officials about Chinese election interference and espionage"},"content":{"rendered":"<p> [ad_1]<br \/>\n<br \/><img decoding=\"async\" src=\"https:\/\/content.fortune.com\/wp-content\/uploads\/2024\/03\/GettyImages-1975536855_4e5634-e1710371560692.jpg?w=2048\" \/><\/p>\n<p>On Wednesday the House passed a bill that could ban TikTok in the U.S., an escalation of the alarms sounded by high-ranking government officials, including commerce chief Gina Raimondo, over Chinese\u00a0 influence on business and politics for years.<\/p>\n<div>\n<p>The bill, which passed by an <a href=\"https:\/\/fortune.com\/2024\/03\/13\/house-passes-tiktok-ban-senate-path-unclear\/\" target=\"_self\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \">overwhelming majority<\/a> (362 to 65, with one representative voting present) in the House, would give TikTok\u2019s Chinese parent company ByteDance a little more than five months to sell the app or face an effective blacklisting\u00a0 from U.S. app marketplaces and web hosting services. The banishment would be enforced by hefty penalties. The bill\u2019s sponsors maintain, however, that the bill <a href=\"https:\/\/fortune.com\/2024\/03\/08\/will-tiktok-be-banned-congress-shutdown\/\" target=\"_self\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \">is not necessarily equivalent to a ban<\/a> because it gives TikTok\u2019s parent company the chance to sell the app and continue operating in the U.S.\u00a0<\/p>\n<p>In a statement, a spokesperson for TikTok lamented that the House bill moved forward so quickly, adding, \u201cThis process was secret and the bill was jammed through for one reason: It\u2019s a ban.\u201d\u00a0<\/p>\n<p>The House vote on Wednesday was a key step toward the bill becoming law, but it still faces an uphill battle in the Senate in part because of increased lobbying by TikTok and objections from some of the app\u2019s 170 million American users. Last week, Congress was <a href=\"https:\/\/fortune.com\/2024\/03\/08\/will-tiktok-be-banned-congress-shutdown\/\" target=\"_self\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \">flooded with calls<\/a> after TikTok prompted its users in the app to complain to their representatives. Some influencers and business owners that make a living from the app have even protested <a href=\"https:\/\/www.5newsonline.com\/video\/news\/national\/influencers-protest-after-the-house-voted-to-ban-tiktok\/527-2d5d23c2-fb09-44ae-a768-0e8dea50d631\" target=\"_blank\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \">in front of the White House<\/a>.<\/p>\n<p>Still, top elected officials and cabinet members have for years been fighting against the growth of Chinese business operations in the U.S. for one reason: possible <a href=\"https:\/\/fortune.com\/2015\/07\/22\/china-global-500-government-owned\/\" target=\"_self\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \">influence<\/a> from the Chinese Communist Party (CCP). Leaders of the U.S. intelligence community on Tuesday warned Congress during a hearing that Chinese influence could lead to myriad domestic threats, including election interference.\u00a0<\/p>\n<p>When asked whether TikTok specifically could be used by the Chinese government to influence U.S. elections, U.S. Director of National Intelligence Avril Haines <a href=\"https:\/\/www.theguardian.com\/technology\/2024\/mar\/13\/china-tiktok-us-election-influence-avril-haines-us-house-of-representatives\" target=\"_blank\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \">said<\/a>, \u201cWe cannot rule out that the CCP would use it.\u201d On the subject of TikTok, FBI Director Christoper Wray emphasized during the congressional hearing that the app poses a threat to U.S. citizens and could compromise their devices.<\/p>\n<p>\u201cAmericans need to ask themselves whether they want to give the Chinese government the ability to control access to their data,\u201d Wray added.<\/p>\n<p>Support for a TikTok ban for national security reasons has come from the leaders of both major parties. Former President Donald Trump tried to ban the app through an <a href=\"https:\/\/fortune.com\/2020\/08\/07\/trump-executive-order-ban-tiktok-tencent-wechat\/\" target=\"_self\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \">executive order<\/a> in 2020, and in 2022 President Biden signed legislation that banned the app from being downloaded on most government-owned devices.<\/p>\n<p>Biden\u2019s Commerce Secretary Raimondo has in the past pushed for more U.S. government oversight and control over Chinese products, and in a recent <a href=\"https:\/\/www.cnbc.com\/2024\/03\/13\/raimondo-says-its-possible-for-chinese-evs-to-one-day-be-on-us-roads.html\" target=\"_blank\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \">interview with CNBC<\/a> said she was receptive to the TikTok ban bill, which President Biden has said he <a href=\"https:\/\/fortune.com\/2024\/03\/11\/joe-biden-supports-bill-forcing-sale-ban-of-tiktok\/\" target=\"_self\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \">will sign<\/a> if it reaches his desk.<\/p>\n<p>\u201cI think we might be able to mitigate the risks [from TikTok] if we had enough tools, but we may not,\u201d Raimondo told CNBC. \u201cAnd I think a ban is something that also needs to be considered.\u201d<\/p>\n<p>Apart from TikTok, Raimondo has also raised concerns over possible espionage by China through Chinese-made electric vehicles, which she <a href=\"https:\/\/www.cnbc.com\/2024\/03\/13\/raimondo-says-its-possible-for-chinese-evs-to-one-day-be-on-us-roads.html\" target=\"_blank\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \">said<\/a> should not be allowed in the U.S. \u201cunless we have very significant controls and conditions around the software and sensors in those cars.\u201d<\/p>\n<p>Last month, the Commerce Department opened an <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/statements-releases\/2024\/02\/29\/fact-sheet-biden-harris-administration-takes-action-to-address-risks-of-autos-from-china-and-other-countries-of-concern\/#:~:text=These%20autos%20are%20constantly%20connecting,these%20vehicles'%20systems%20or%20data.\" target=\"_blank\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \">investigation<\/a> into \u201cconnected vehicles\u201d that use technology from countries such as China. These vehicles are increasingly equipped with advanced tech that could pose a threat to national security in some cases, according to the White House.<\/p>\n<p>\u201cNew vulnerabilities and threats could arise with connected autos if a foreign government gained access to these vehicles\u2019 systems or data,\u201d the White House <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/statements-releases\/2024\/02\/29\/fact-sheet-biden-harris-administration-takes-action-to-address-risks-of-autos-from-china-and-other-countries-of-concern\/#:~:text=These%20autos%20are%20constantly%20connecting,these%20vehicles'%20systems%20or%20data.\" target=\"_blank\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \">wrote<\/a>.\u00a0<\/p>\n<p>And it\u2019s not just electric vehicles. Government officials like the FBI\u2019s Wray have increasingly warned that China is working to covertly implement malware in critical U.S. infrastructure and isn\u2019t just focused on political and military targets<\/p>\n<p>\u201cChina\u2019s hackers are positioning on American infrastructure in preparation to wreak havoc and cause real world harm to American citizens and communities if and when China decides the time has come to strike,\u201d Wray said before the <a href=\"http:\/\/selectcommitteeontheccp.house.gov\/\" target=\"_blank\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \">House China committee<\/a> in February.<\/p>\n<p>Last week, the <em>Wall Street Journal<\/em> <a href=\"https:\/\/www.wsj.com\/politics\/national-security\/espionage-probe-finds-communications-device-on-chinese-cargo-cranes-867d32c0\" target=\"_blank\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \">reported<\/a> that a congressional probe found communication equipment on Chinese-manufactured cargo cranes operating in U.S. ports that were not used in its normal operations, leading to renewed espionage concerns.
