But its EVs have not flooded the U.S., where protectionist trade policies have kept them at bay.\u00a0<\/p>\n<div>\n<p>So how would<a href=\"https:\/\/fortune.com\/europe\/2024\/01\/23\/volkswagen-top-car-seller-china-byd-warren-buffett-berkshire-hathaway\/\" target=\"_self\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \"> <\/a>China\u2019s <a href=\"https:\/\/fortune.com\/europe\/2024\/01\/23\/volkswagen-top-car-seller-china-byd-warren-buffett-berkshire-hathaway\/\" target=\"_self\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \">top carmaker<\/a> fare in America if free to roam? That\u2019s anyone\u2019s guess, but Australia might offer some insights.<\/p>\n<p>Down Under, BYD faces<a href=\"https:\/\/www.drive.com.au\/news\/import-tariff-cut-gives-luxury-brands-a-boost\/\" target=\"_blank\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \"> no tariffs<\/a>. Australia has no domestic carmakers to protect. The current government has heavily promoted the adoption of electric vehicles since coming to power in 2022. In other words, little is hindering BYD\u2014and it\u2019s growing quickly.<\/p>\n<p>After entering the market in 2022, BYD now has 14% of Australia\u2019s EV market,<a href=\"https:\/\/www.reuters.com\/business\/autos-transportation\/byd-spearheads-chinese-electric-car-push-australia-friendlier-market-2024-03-05\/\" target=\"_blank\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \"> reports<\/a> Reuters. Tesla leads at 53%, but it\u2019s had a big head start, having launched sales Down Under<a href=\"https:\/\/www.theguardian.com\/environment\/2014\/dec\/10\/tesla-begins-selling-electric-vehicles-in-australia-and-plans-charging-network\" target=\"_blank\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \"> in 2014<\/a>.<\/p>\n<p>Tesla CEO Elon Musk knows what he\u2019s up against. Last year, he<a href=\"https:\/\/fortune.com\/2023\/05\/27\/elon-musk-byd-china-tesla\/\" target=\"_self\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \"> admitted<\/a> BYD cars are \u201chighly competitive these days\u201d after a 2011 video resurfaced showing him laughing them off at the time.<\/p>\n<p>BYD, backed by Warren Buffett\u2019s <a href=\"https:\/\/fortune.com\/company\/berkshire-hathaway\/\" target=\"_blank\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \">Berkshire Hathaway<\/a>, watched its sales in Australia grow sixfold last year to over 12,000 vehicles. And it\u2019s moving quickly to grab more market share. This year, it will double the number of models it sells to six, adding a pickup truck and two SUVs to the<a href=\"https:\/\/www.drive.com.au\/showrooms\/byd\/\" target=\"_blank\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \"> current lineup<\/a> (a sedan, a hatchback, and an SUV). Its distributor in Australia, EVDirect, will nearly double the number of its dealerships over the next year and a half, with plans to add 30 more.<\/p>\n<p>\u201cThe opportunity is very clear,\u201d EVDirect CEO David Smitherman told Reuters.\u00a0<\/p>\n<h2 class=\"wp-block-heading\">Australia is an exception<\/h2>\n<p>By contrast, the picture is murkier for BYD in the U.S., where lawmakers have<a href=\"https:\/\/fortune.com\/2023\/12\/30\/chinese-electric-vehicles-makers-mexico-plans-spark-fears-in-us\/\" target=\"_self\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \"> warned about<\/a> Chinese EVs flooding the market and hurting domestic automakers. Currently in America, made-in-China EVs are subject to a 25% tariff, which goes atop a 2.5% tariff on imported cars.\u00a0<\/p>\n<p>Last month, the Biden administration<a href=\"https:\/\/apnews.com\/article\/china-electric-vehicles-privacy-personal-data-biden-844f2406512b94212ee1a92a61e5a33a\" target=\"_blank\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \"> opened<\/a> an investigation into security threats posed by Chinese EVs, saying the vehicles could gather sensitive information about drivers.<\/p>\n<p>\u201cChina is determined to dominate the future of the auto market, including by using unfair practices,\u201d said President Joe Biden. \u201cChina\u2019s policies could flood our market with its vehicles, posing risks to our national security. I\u2019m not going to let that happen on my watch.\u201d<\/p>\n<p>Australia\u2019s government has given no indication that it has similar security concerns.<\/p>\n<p>The EU has so far been less protectionist than the U.S. regarding Chinese EVs, but the European Commission, which is<a href=\"https:\/\/fortune.com\/europe\/2023\/09\/13\/europe-opens-probe-china-cheap-evs-flooding-eu-vdl-state-subsidies\/\" target=\"_self\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \"> conducting a probe<\/a>, said this week it\u2019s found evidence that they\u2019re being unfairly subsidized. Should the full investigation back that assertion, Chinese EVs could be hit with retroactive tariffs. EU regulators, with that in mind, today<a href=\"https:\/\/www.reuters.com\/business\/autos-transportation\/eu-set-allow-possible-retroactive-tariffs-chinese-evs-2024-03-05\/\" target=\"_blank\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \"> began<\/a> customs registration of Chinese EVs.\u00a0<\/p>\n<p>But Down Under, little stands in the way of BYD and rival Chinese EV makers.
