Though the visa holders can work in any field, they\u2019re especially prevalent in tech and other STEM jobs, including AI. Top companies including <a href=\"https:\/\/fortune.com\/company\/amazon-com\/\" target=\"_blank\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \">Amazon<\/a>, Meta, and <a href=\"https:\/\/fortune.com\/company\/salesforce-com\/\" target=\"_blank\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \">Salesforce<\/a> have <a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2022-11-21\/2022-tech-layoffs-leave-h-1b-visa-holders-in-limbo\" target=\"_blank\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \">sponsored tens of thousands of H-1B workers<\/a> over the past few years alone.<\/p>\n<p>The visas have become a talking point among anti-immigration conservatives. Donald Trump controversially <a href=\"https:\/\/www.nytimes.com\/2020\/06\/22\/us\/politics\/trump-h1b-work-visas.html\" target=\"_blank\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \">suspended the program temporarily while in office<\/a>, while presidential hopeful Vivek Ramaswamy <a href=\"https:\/\/www.politico.com\/news\/2023\/09\/16\/ramaswamy-h1b-visa-gop-visa-00116383\" target=\"_blank\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \">said<\/a> he would \u201cgut\u201d the program and create an \u201cactual meritocratic admission.\u201d Other critics say recipients take away jobs from Americans.<\/p>\n<p>But tech leaders, many of whom <a href=\"https:\/\/www.businessinsider.com\/top-immigrant-tech-execs-venture-capitalists-oppose-trump-work-visas-2020-7\" target=\"_blank\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \">spoke out against Trump\u2019s visa freeze<\/a>, say the U.S. actually has the opposite problem: Rather than restricting the H-1B program, it should be expanded. Currently, 65,000 visas\u2014a figure that hasn\u2019t changed in more than two decades\u2014can be awarded each year via a lottery, while another 20,000 can go to those who earn a graduate degree in the U.S.<\/p>\n<p>Demand is overwhelming supply: In 2023, hundreds of thousands of applicants were denied. That hurts those workers, of course, but also companies, says Allison Ahern Fillo, a Boston-based <a href=\"https:\/\/www.davismalm.com\/people\/allison-ahern-fillo\/\" target=\"_blank\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \">immigration attorney<\/a>. Some companies she represents are forced to apply for a visa for the same job candidate multiple years in a row.<\/p>\n<p>\u201cIt\u2019s really unfortunate that a U.S. employer wants to be able to employ someone and it\u2019s really up to chance,\u201d Fillo tells <em>Fortune<\/em>. \u201cThey vetted the person, they\u2019re the right person for the job.\u201d<\/p>\n<p>Aaron Levie, CEO of cloud company <a href=\"https:\/\/fortune.com\/company\/box\/\" target=\"_blank\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \">Box<\/a>, recently wrote on <a href=\"https:\/\/fortune.com\/company\/twitter\/\" target=\"_blank\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \">X<\/a> that the discrepancy between demand and the number of visas granted should \u201cmake you go insane.\u201d <\/p>\n<p>\u201cWe are actively shooting our future selves in the foot,\u201d he wrote. Levie did not respond to <em>Fortune<\/em>\u2018s request for an interview.<a href=\"https:\/\/twitter.com\/levie\/status\/1742946195893559482\/photo\/1\" target=\"_blank\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \"><\/p>\n<blockquote class=\"twitter-tweet\">\n<p lang=\"en\" dir=\"ltr\">This chart should make you go insane. We are actively shooting our future selves in the foot. <a href=\"https:\/\/t.co\/kYA8BDhzHC\" target=\"_blank\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \">pic.twitter.com\/kYA8BDhzHC<\/a><\/p>\n<p>\u2014 Aaron Levie (@levie) <a href=\"https:\/\/twitter.com\/levie\/status\/1742946195893559482?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \">January 4, 2024<\/a><\/p><\/blockquote>\n<p>Research has found that hiring these migrant workers <a href=\"https:\/\/nfap.com\/wp-content\/uploads\/2020\/05\/The-Impact-of-H-1B-Visa-Holders-on-the-U.S.-Workforce.NFAP-Policy-Brief.May-2020.pdf\" target=\"_blank\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \">doesn\u2019t adversely affect the economy<\/a>, as some allege, but rather leads to further job creation and <a href=\"https:\/\/fortune.com\/2024\/03\/06\/h-1b-visas-85000-falling-behind-tech-ai-artificial-intelligence\/file:\/\/\/Users\/aadamczyk\/Downloads\/null-001.2021.issue-088-en.pdf\" target=\"_blank\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \">economic growth for myriad reasons<\/a>: These workers <a href=\"https:\/\/www.nber.org\/system\/files\/working_papers\/w27075\/w27075.pdf\" target=\"_blank\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \">drive innovation<\/a>, pay U.S. taxes, <a href=\"https:\/\/www.nber.org\/papers\/w27778\" target=\"_blank\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \">start new businesses<\/a>, and so on.<\/p>\n<p>Restricting immigration ultimately harms companies and <a href=\"https:\/\/www.mercatus.org\/research\/policy-briefs\/unintended-consequences-restrictions-h-1b-visas\" target=\"_blank\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \">slows wage growth<\/a>. Research by Britta Glennon, a professor at the University of Pennsylvania, finds that when companies cannot fill the roles with U.S. workers and are unable to hire high-skilled foreigners, they <a href=\"https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=3547655\" target=\"_blank\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \">actually offshore more jobs<\/a>.<\/p>\n<p>\u201c<a href=\"https:\/\/fortune.com\/company\/microsoft\/\" target=\"_blank\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \">Microsoft<\/a> has found that for every H-1B hire we make, we add on average four additional employees to support them in various capacities,\u201d Bill Gates <a href=\"https:\/\/www.science.org\/content\/article\/mr-gates-goes-washington\" target=\"_blank\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \">told members of Congress back in 2008<\/a>.<\/p>\n<p>Advocates of increasing the cap on visas also note that it\u2019s not just the tech sector that would benefit: There\u2019s plenty of demand in <a href=\"https:\/\/shmpublications.onlinelibrary.wiley.com\/doi\/abs\/10.12788\/jhm.3473\" target=\"_blank\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \">fields like medicine<\/a> and scientific research where there simply aren\u2019t enough American candidates.<\/p>\n<p>What makes increasing the cap even more crucial, Fillo says, is that the H-1B visa is one of the only ways for educated foreigners to work in the U.S. at all\u2014and eventually become residents or citizens.<\/p>\n<p>\u201cWhen we can\u2019t hire and retain the top non-native talent, we hand global competitors what used to be America\u2019s greatest edge,\u201d Ben Zweig, a labor economist and the CEO of Revelio Labs, <a href=\"https:\/\/fortune.com\/2023\/05\/26\/90-of-laid-off-h1-b-visa-holders-were-able-to-find-new-work-against-all-odds-heres-what-the-data-tells-us-about-americas-complicated-relationship-with-foreign-born-talent\/\" target=\"_self\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \">previously wrote for <em>Fortune<\/em><\/a>. \u201cSolving this issue will help firms get the talent they need, help our cities grow, and create a more efficient and fairer workforce.\u201d<\/p>\n<h2 class=\"wp-block-heading\">Recent changes to visas<\/h2>\n<p>The Biden administration has <a href=\"https:\/\/www.wsj.com\/articles\/u-s-to-allow-h-1b-workers-to-renew-visas-without-leaving-country-5ad83f54\" target=\"_blank\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \">made a few changes<\/a> to the program in the past year unrelated to raising the cap, including allowing <a href=\"https:\/\/news.bloomberglaw.com\/daily-labor-report\/h-1b-domestic-visa-renewal-pilot-program-begins-as-demand-soars\" target=\"_blank\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \">some applicants to renew their visas in the U.S.<\/a>, rather than requiring them to travel to their home country and renew it in a U.S. consulate.<\/p>\n<p>U.S. Citizenship and Immigration Services also made changes to the annual lottery. In recent years, USCIS found that the same applicant was being submitted by multiple companies in order to game the system and increase their chances of being selected. This year, an individual can only enter once.<\/p>\n<p>Additionally, the Biden administration has <a href=\"https:\/\/thehill.com\/latino\/4271314-dhs-proposes-changes-h-1b-work-visas\/\" target=\"_blank\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \">proposed a change<\/a> that would require an applicant\u2019s job to be \u201cdirectly related\u201d to their studies, and to the needs of any given job. Immigration experts say that could make things more difficult for visa holders who don\u2019t necessarily end up with a job in a field related to what they studied. They are also proposing allowing entrepreneurs to sponsor themselves.<\/p>\n<p>And of course, there are other objections to the program. Some critics have accused employers of <a href=\"https:\/\/www.epi.org\/blog\/tech-and-outsourcing-companies-continue-to-exploit-the-h-1b-visa-program-at-a-time-of-mass-layoffs-the-top-30-h-1b-employers-hired-34000-new-h-1b-workers-in-2022-and-laid-off-at-least-85000-workers\/\" target=\"_blank\" rel=\"noopener\" class=\"sc-47dba8f0-0 iRbseu styledLinkColor \">exploiting the program<\/a>, and using it to hire foreign workers while firing U.S. employees.
