Less than a week after Nintendo filed the legal action, accusing the emulator\u2019s creators of \u201cpiracy at a colossal scale,\u201d a joint final judgment and permanent injunction filed Tuesday says Tropic Haze has agreed to pay the Mario maker $2.4 million, along with a long list of concessions.<\/p>\n<p>Nintendo\u2019s lawsuit claimed Tropic Haze violated the anti-circumvention and anti-trafficking provisions of the <a data-i13n=\"cpos:2;pos:1\" href=\"https:\/\/www.engadget.com\/the-nba-nfl-and-ufc-want-instantaneous-dmca-takedowns-200047711.html\" data-ylk=\"slk:Digital Millennium Copyright Act (DMCA);cpos:2;pos:1;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">Digital Millennium Copyright Act (DMCA)<\/a>. \u201cWithout Yuzu\u2019s decryption of Nintendo\u2019s encryption, unauthorized copies of games could not be played on PCs or Android devices,\u201d the company wrote in its complaint. It described Yuzu as \u201csoftware primarily designed to circumvent technological measures.\u201d<\/p>\n<p>Yuzu launched in 2018 as free, open-source software for Windows, Linux and Android. In addition to paying Nintendo $2.4 million, it must permanently refrain from \u201cengaging in activities related to offering, marketing, distributing, or trafficking in Yuzu emulator or any similar software that circumvents Nintendo\u2019s technical protection measures.\u201d<\/p>\n<p>Tropic Haze must also delete all circumvention devices, tools and Nintendo cryptographic keys used in the emulator and turn over all circumvention devices and modified Nintendo hardware. It even has to surrender the emulator\u2019s web domain (including any variants or successors) to Nintendo. (The website is still live now, perhaps waiting for the judgment\u2019s final a-okay.) Not abiding by the settlement\u2019s agreements could land Tropic Haze in contempt of court, including punitive, coercive and monetary actions.<\/p>\n<p>Although piracy is the top motive for many emulator users, the software can double as crucial tools for <a data-i13n=\"cpos:9;pos:1\" href=\"https:\/\/www.engadget.com\/sony-playstation-game-preservation-team-143059442.html\" data-ylk=\"slk:video game preservation;cpos:9;pos:1;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">video game preservation<\/a> \u2014\u00a0making rapid legal surrenders like Tropic Haze\u2019s potentially problematic. Without emulators, Nintendo and other copyright holders could make games obsolete for future generations as older hardware eventually becomes more difficult to find.<\/p>\n<p>Nintendo\u2019s legal team is, of course, no stranger to aggressively enforcing copyrighted material. It\u2019s safe to say the Mario maker doesn\u2019t share preservationists\u2019 views on the crucial historical role emulators can play.<\/p>\n<p>Despite the settlement, it appears unlikely the open-source Yuzu will disappear entirely.
